Shall Section 12.1 of Article V of the Charter of Mayfield <br />Village, Ohio, be enacted to read as follows: <br />°In all zoning or land use classification districts <br />other than single family residential, the Council <br />shall have the sole and exclusive authority to <br />permit excepts to and variances from the Planning & <br />Zoning Code and Building Code Regulations in <br />individual cases as may be required to afford justice <br />and avoid unreasonable hardship to property owners or <br />users, with such exceptions or variances to be permitted <br />with the concurrence of a majority of the members <br />elected to Council and which shall include, but not <br />be limited to, restrictions on the height of buildings <br />and other structures, size of parcels, the size, bulk, <br />and location of buildings and other structures, <br />percentage of lot occupancy, setback building lines, <br />and the area of yards, courts and other open spaces." <br />The question to appear on the ballot shall be as follows: <br />(0) Shall the Charter of Mayfield Village, Ohio, <br />be amended so as to specify that only the <br />Council has the authority to grant exceptions <br />to and variances from the regulations of the <br />Planning and Zoning and Building Codes for <br />properties in zoning or land use classification <br />districts other than single family residential <br />with a majority vote of Council necessary to <br />grant such exception or variance? <br />P. Shall Article XI of the Charter of Mayfield Village, Ohio, <br />be amended by deleting the current Article in its entirety <br />and substituting therefor the following wording: <br />"At the General Election in November of 1980, and <br />at the General Election in November of each fifth <br />year thereafter, a Charter Review Commission consisting <br />of at least seven (7) members and not more than eleven <br />(11) members shall be elected. Each member of each <br />such Commission shall have physically resided in and <br />been a qualified elector of the Municipality for at <br />least three (3) continuous years immediately prior to <br />his election, and shall continue to physically reside <br />in the municipality throughout his term of office. <br />No elected official or employee of the Municipality <br />shall be eligible to serve on a Charter Review <br />Commission. Each Charter Review Commission shall cease <br />to function on the day of the next November election <br />
