M.V.,ORDINANCE N0. 86-15 <br />Page -9- <br />the President of Council to become acting Mayor? <br />J. Shall Section 9 of Article IV of the Charter of Mayfield <br />Village, Ohio, be amended by deleting the current Section <br />in its entirety and substituting therefor the following <br />wording: <br />"The Council may remove the Mayor for gross misconduct, <br />or malfeasance in or disqualification for office, or <br />for the conviction while in office of a crime involving <br />moral terpitude, or if adjudicated legally incompetent, <br />or for a violation of his oath of office; provided, <br />however, that such removal shall not take place without <br />the affirmative vote of two-thirds (2/3) of the members <br />elected to Council nor until the Mayor shall have been <br />notified in writing of the charge against him at least <br />fifteen (15) days in advance of a public hearing upon <br />such charge, and he or his counsel have been given an <br />opportunity at such hearing to be heard, present evidence <br />and examinate any witness appearing in support of the <br />charge. <br />The question to appear on the ballot shall be as follows: <br />(J), Shall the Charter of Mayfield Village, Ohio, <br />be amended such that the affirmative vote of <br />two-thirds (2/3) of the members elected to <br />Council, instead of a unanimous vote of the <br />members of Council, is necessary to remove the <br />Mayor from office? <br />K. Shall Section 1 of Article V of the Charter of Mayfield <br />Village, Ohio, be amended by deleting the current Section <br />in its entirety and substituting therefor the following <br />wording: <br />"The Municipality shall have an Architectural Review <br />Board, a Recreation Board, a Law Department, a Finance <br />Department, a Civil Service Commission, a Department <br />of Public Service, a Police Department, a Fire <br />Department, a Building Department, a Planning & Zoning <br />Commission, a Board of Appeals and a Commission on <br />Aging. The Council shall provide by ordinance for <br />the organization and duties thereof not provided by <br />this Charter. The Council may establish by ordinance <br />new administrative offices, departments, boards and <br />commissions or divisions thereof and, with the <br />exception of the offices, departments, boards and <br />commissions established by this Charter, may combine <br />or abolish such offices, departments, boards and <br />commissions or divisions thereof as it may deem to <br />
