ORDINANCE N0. 86- ~5 <br />Page =8- <br />(8) have custody of the seal of the Municipality <br />and affix it to all of the of oresaid documents, <br />but the absence of the seal shall not affect the <br />validity of any such instrument; and (9) perform <br />such other duties as are conferred or required by <br />this Charter, by any ordinance or resolution of the <br />Council or by the general laws of the State of Ohio <br />not inconsistent therewith. The Mayor shall be <br />recognized as the official and ceremonial head of the <br />municipal government by the Governor of Ohio for <br />military purposes, and by the Courts for the purpose <br />of serving civil processes. <br />The question to appear on the ballot shall be as follows: <br />(H) Shall the Charter of Mayfield Village, Ohio, <br />be amended so as to require that the Mayor, <br />and the President of Council are necessary to <br />execute contracts, conveyances, evidences of <br />indebtedness and all other instruments <br />to which the municipality is a party? <br />I. Shall Section 7 of Article IV of the Charter of Mayfield <br />Village, Ohio, be amended by deleting the current Section <br />in its entirety and substituting therefor the following <br />wording: <br />"When the Mayor is absent from the Municipality, or <br />for any reason is unable to perform the duties of <br />Mayor, the President of Council shall become the <br />acting Mayor, and while so acting shall have and <br />exercise all of the powers of the Mayor, but he shall <br />not thereby cease to be the President of Council. <br />When both the Mayor and the President of Council are <br />absent from the Municipality, or for an reason both <br />are unable to perf orm the duties as Mayor, the President <br />Pro Tem of the Council shall become the acting Mayor, <br />and while so acting shall have and exercise all of <br />the powers of the Mayor, but he shall not thereby <br />cease to be the President Pro Tem of the Council. A <br />majority of the members elected to Council shall <br />determine when the absence or. inability to perf orm <br />duties of the officials named herein requires the <br />implementation of the provisions of this Section." <br />The question to appear on the ballot shall be as follows: <br />(I) Shall the Charter of Mayfield Village, Ohio, <br />be amended such that a majority of the members <br />elected to Council shall determine when the <br />absence of the Mayor, or the Mayor's inability <br />to perform the duties of that office, require <br />
