ORDINANCE N0. 86- 27 <br />Page -2- <br />LIQUOR, OR ALLOW ANY PERSON UNDER THE <br />(19) YEARS TO REMAIN ON SUCH PREMISES <br />POSSESSION OF BEER OR WHILE CONSUMING <br />OF THIS CHAPTER. <br />AGE OF NINETEEN <br />WH IL E IN TH E <br />BEER, IN VIOLATION <br />f~} (k) Whoever violates subsection (b) hereof is <br />guilty of a minor misdemeanor. Whoever violates any <br />other provisions of this Section is guilty of a misde- <br />meanor of the first degree, except that a juvenile <br />offender under the age of eighteen (18) years shall be <br />proceeded against as may be appropriate under Ohio R.C. <br />Chapter 2151. <br />Section 2. All prior ordinances inconsistent with this <br />ordinance in whole or in part are hereby repealed to the extent <br />necessary to avoid conflict with this ordinance. <br />Section 3. That the Council finds and determines that all <br />formal actions of this Council relating to the adoption of this <br />Ordinance have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in <br />compliance with all statutory requirements including the requirements <br />of Section 121.22 of the Ohio Revised Code. <br />Section 4. This Ordinance is hereby declared to be an <br />emergency measure necessary for the immed~.ate preservation of the <br />health, safety and welfare of the residents of Mayfield Village for <br />the reason that the Section enacted herein is necessary to maintain <br />effective law enforcement in the area of alcohol consumption by <br />minors.
