ORDINANCE N0. 87- 13 INTRODUCED BY: Mayor Carmen & Council as a Whole AN ORDINANCE SUBMITTING TO THE ELECTORATE OF MAYFIELD VILLAGE, OHIO, A PROPOSED AMENDMENT TO THE CHARTER OF THE VILLAGE PERTAINING TO THE APPOINTMENT OF A DIRECTOR OF LAW, PROVIDING FOR ALL NECESSARY PROCEDURES IN CONNECTION THEREWITH AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: Section 1. Pursuant to Article X of the Charter of Mayfield Village, Ohio, the Vilage Council proposes the following amendment to the Charter of the Village, said proposed amendment to be submitted to the electorate of the municipality at their regularly scheduled General Election to be held on the third day of November, 1987. The proposed amendment shall be designated by a ballot question number and shall be further designated by an individually lettered subheading. The proposed amendment and respective ballot question shall be as follows: A. Shall Article V, Section 4 of the Charter of Mayfield Village, Ohio be amended by deleting the tenth sentence thereof so that it reads as follows: "The Law Director shall be the chief legal officer of the Municipality. The Law Director shall be provided with such assistants as the Council may, from time-to-time, deem necessary and desirable. The Laia Director and such assistants shall be appointed or removed by the Mayor subject to the confirmation by vote of the majority of the members elected to Council. Every second year, commencing in the year 1988, at the first meeting of Council immediately after the preceding general election, the Mayor shall either reappoint the Law Director or make a new appointment, each of which shall be subject to confirmation by a majority vote of the members of Council. The Mayor may appoint special counsel to augment the services of the Law Director, and his assistants, or substitute for them. Such appointment shall only be made after the Law Director has certified to the Mayor and Council, in writing, that he is unable, or incapable, of representing the Niunicipality in a specific matter. Such appointment of special counsel shall be subject to confirmation by a majority vote of Council. The Law Director will receive no compensation for any services relating to a matter for which special counsel has been appointed. The Law Director shall be an attorney-at- law in good standing admitted to the practice of law in the State of Ohio for a period of at least five (5) years, but need not be a resident of the Municipality.
