ORDINANCE N0. 87- 13 <br />INTRODUCED BY: Mayor Carmen & Council as a Whole <br />AN ORDINANCE SUBMITTING TO THE ELECTORATE OF <br />MAYFIELD VILLAGE, OHIO, A PROPOSED AMENDMENT TO <br />THE CHARTER OF THE VILLAGE PERTAINING TO THE <br />APPOINTMENT OF A DIRECTOR OF LAW, PROVIDING FOR <br />ALL NECESSARY PROCEDURES IN CONNECTION THEREWITH <br />AND DECLARING AN EMERGENCY. <br />BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. Pursuant to Article X of the Charter of <br />Mayfield Village, Ohio, the Vilage Council proposes the following <br />amendment to the Charter of the Village, said proposed amendment to be <br />submitted to the electorate of the municipality at their regularly <br />scheduled General Election to be held on the third day of November, <br />1987. The proposed amendment shall be designated by a ballot question <br />number and shall be further designated by an individually lettered <br />subheading. The proposed amendment and respective ballot question <br />shall be as follows: <br />A. Shall Article V, Section 4 of the Charter of <br />Mayfield Village, Ohio be amended by deleting the tenth <br />sentence thereof so that it reads as follows: <br />"The Law Director shall be the chief legal officer of the <br />Municipality. The Law Director shall be provided with such <br />assistants as the Council may, from time-to-time, deem <br />necessary and desirable. The Laia Director and such <br />assistants shall be appointed or removed by the Mayor <br />subject to the confirmation by vote of the majority of the <br />members elected to Council. Every second year, commencing <br />in the year 1988, at the first meeting of Council <br />immediately after the preceding general election, the Mayor <br />shall either reappoint the Law Director or make a new <br />appointment, each of which shall be subject to confirmation <br />by a majority vote of the members of Council. The Mayor may <br />appoint special counsel to augment the services of the Law <br />Director, and his assistants, or substitute for them. Such <br />appointment shall only be made after the Law Director has <br />certified to the Mayor and Council, in writing, that he is <br />unable, or incapable, of representing the Niunicipality in a <br />specific matter. Such appointment of special counsel shall <br />be subject to confirmation by a majority vote of Council. <br />The Law Director will receive no compensation for any <br />services relating to a matter for which special counsel has <br />been appointed. The Law Director shall be an attorney-at- <br />law in good standing admitted to the practice of law in the <br />State of Ohio for a period of at least five (5) years, but <br />need not be a resident of the Municipality. The Law <br />Director shall be the principal legal advisor and attorney <br />for the Municipality and its officers, departments, boards
