The question to appear on the ballot shall be as follows: A. Shall Article V, Section 4 of the Charter of Mayfield Village, Ohio, be amended so as to delete the prohibition against the Law Director serving in a similar capacity with an adjacent community sharing a common border with Mayfield Village? Section 2. The Clerk of Council is hereby authorized and directed to certify a copy of this Ordinance to the Cuyahoga County Board of Elections not less than sixty (60) nor more than one hundred twenty (120) days prior to the regularly scheduled General Election on November 3, 1987, in order to have the ballot issue contained herein placed on the ballot for the said General Election and to take whatever other steps are necessary in order to comply with all directives of the said Board of Elections in order to secure placement on the ballot as aforesaid. Section 3. The Director of Law is hereby authorized and directed to confer with the Board of Elections of Cuyahoga County, Ohio and the Secretary of State for the State of Ohio regarding the ballot question and to make any changes necessary to comply with current election law so long as the substance of any issue is not changed. In the event of the necessity of a substantial change of any issue the Council shall first be consulted. Section 4. At least thirty (30) days prior to the date of the election as set forth in this Ordinance, the Clerk of Council is hereby directed to mail a copy of the full text of the proposed Charter amendment to each elector of the municipality whose name appears upon the registration books for the last regular election held in the municipality. Section 5. That the Council finds and determines that all formal actions of this Council relating to the adoption of this Ordinance have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code. Section 6. This Ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the health, safety and welfare of the residents of Mayfield Village for the reason that the proposed Charter Amendment presented herein must be timely filed with the Board of Elections in accordance with current Ohio law in order to allow the electorate the opportunity to vote
