ORDINANCE N0. 87-13 <br />Page -2- <br />and commissions in their official capacities, and shall <br />perform such other duties, consistent with this office, as <br />may be assigned form time-to-time by the Mayor and Council." <br />The question to appear on the ballot shall be as follows: <br />A. Shall Article V, Section 4 of the Charter of Mayfield <br />Village, Ohio, be amended so as to delete the <br />prohibition against the Law Director serving in a <br />similar capacity with an adjacent community sharing <br />a common border with Mayfield Village? <br />Section 2. The Clerk of Council is hereby authorized and <br />directed to certify a copy of this Ordinance to the Cuyahoga County <br />Board of Elections not less than sixty (60) nor more than one hundred <br />twenty (120) days prior to the regularly scheduled General Election on <br />November 3, 1987, in order to have the ballot issue contained herein <br />placed on the ballot for the said General Election and to take <br />whatever other steps are necessary in order to comply with all <br />directives of the said Board of Elections in order to secure placement <br />on the ballot as aforesaid. <br />Section 3. The Director of Law is hereby authorized and <br />directed to confer with the Board of Elections of Cuyahoga County, <br />Ohio and the Secretary of State for the State of Ohio regarding the <br />ballot question and to make any changes necessary to comply with <br />current election law so long as the substance of any issue is not <br />changed. In the event of the necessity of a substantial change of any <br />issue the Council shall first be consulted. <br />Section 4. At least thirty (30) days prior to the date of <br />the election as set forth in this Ordinance, the Clerk of Council is <br />hereby directed to mail a copy of the full text of the proposed <br />Charter amendment to each elector of the municipality whose name <br />appears upon the registration books for the last regular election held <br />in the municipality. <br />Section 5. That the Council finds and determines that all <br />formal actions of this Council relating to the adoption of this <br />Ordinance have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in <br />compliance with all statutory requirements including the requirements <br />of Section 121.22 of the Ohio Revised Code. <br />Section 6. This Ordinance is hereby declared to be an <br />emergency measure necessary for the immediate preservation of the <br />health, safety and welfare of the residents of Mayfield Village for <br />the reason that the proposed Charter Amendment presented herein must <br />be timely filed with the Board of Elections in accordance with current <br />Ohio law in order to allow the electorate the opportunity to vote
