ORDINANCE N0. 87-28 INTRODUCED BYa Mayor Carmen & Council as a Whole AN ORDINANCE SUBMITTING TO THE ELECTORATE OF MAYFIELD VILLAGE, OHIO, A PROPOSED P,MENDMENT TO THE CHARTER OF TH E VILLAGE PERTAINING TO COUNCIL Z ON ING POWERS, PROV IDIiVG FOR ALL NECESSARY PROCEDURES IN CONIVECTION THEREWITH AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: Section l. Pursuant to Article X of the Charter of Mayfield Village, Ohio, the Village Council proposes the following amendment to the Charter of the Village, said proposed amendment to be submitted to the electorate of the municipality at the regularly scheduled General Election to be held on the third day of November, 1987. The,proposed amendment shall be designated by a ballot question number and shall be further designated by an individually lettered subheading. The proposed amendment and respective ballot questions shall be as follows: Shall Article V, Section 12.1 of the Charter of Mayfield Village, Ohio, entitled "Council Zoning Powers" be repealed in its entirety. The question to appear on the ballot shall be as follows: Shall Article V, Section 12.1 of the Charter of Mayfield Village, Ohio, entitled "Council Zoning Powers°" be repealed in its entirety? Section 2. The Clerk of Council is hereby authori.z.ed and directed to immediately certify a copy of this Ordinance to the Cuyahoga County Boarc7 of Elections in order to have the ballot issue contained herein placed on the ballot f or the general election to be held on November 3, 1987 and to take whatever other steps are necessary in order to comply with all directives of the said Board of Elections in order to secure placement on the ballot as aforesaid. Section 3e The Director of Law is hereby authorized and directed to confer with the Board of Elections of Cuyahoga County, Ohio, and the Secretary of State for the State of Ohio regarding the ballot question and to make any changes necessary to comply with current election law so long as the substance of any issue is not changed. In the event of the necessity of a substantial change of any issue the Council shall first be consulted. Section 4. The Clerk of Council is hereby authorized and directed to either mail a copy of the full text of the proposed Charter Amendment at least thirty (30) days prior to the date of the election as set forth in this Ordinance to each elector of the munici- pality whose name appears upon the registration books for the last
