ORDINANCE N0. 87-28 <br />INTRODUCED BYa Mayor Carmen & Council as a Whole <br />AN ORDINANCE SUBMITTING TO THE ELECTORATE OF <br />MAYFIELD VILLAGE, OHIO, A PROPOSED P,MENDMENT TO <br />THE CHARTER OF TH E VILLAGE PERTAINING TO COUNCIL <br />Z ON ING POWERS, PROV IDIiVG FOR ALL NECESSARY <br />PROCEDURES IN CONIVECTION THEREWITH AND DECLARING <br />AN EMERGENCY. <br />BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />Section l. Pursuant to Article X of the Charter of <br />Mayfield Village, Ohio, the Village Council proposes the following <br />amendment to the Charter of the Village, said proposed amendment to be <br />submitted to the electorate of the municipality at the regularly <br />scheduled General Election to be held on the third day of November, <br />1987. The,proposed amendment shall be designated by a ballot question <br />number and shall be further designated by an individually lettered <br />subheading. The proposed amendment and respective ballot questions <br />shall be as follows: <br />Shall Article V, Section 12.1 of the Charter of <br />Mayfield Village, Ohio, entitled "Council Zoning <br />Powers" be repealed in its entirety. <br />The question to appear on the ballot shall be as follows: <br />Shall Article V, Section 12.1 of the Charter of <br />Mayfield Village, Ohio, entitled "Council Zoning <br />Powers°" be repealed in its entirety? <br />Section 2. The Clerk of Council is hereby authori.z.ed and <br />directed to immediately certify a copy of this Ordinance to the <br />Cuyahoga County Boarc7 of Elections in order to have the ballot issue <br />contained herein placed on the ballot f or the general election to be <br />held on November 3, 1987 and to take whatever other steps are <br />necessary in order to comply with all directives of the said Board of <br />Elections in order to secure placement on the ballot as aforesaid. <br />Section 3e The Director of Law is hereby authorized and <br />directed to confer with the Board of Elections of Cuyahoga County, <br />Ohio, and the Secretary of State for the State of Ohio regarding the <br />ballot question and to make any changes necessary to comply with <br />current election law so long as the substance of any issue is not <br />changed. In the event of the necessity of a substantial change of any <br />issue the Council shall first be consulted. <br />Section 4. The Clerk of Council is hereby authorized and <br />directed to either mail a copy of the full text of the proposed <br />Charter Amendment at least thirty (30) days prior to the date of the <br />election as set forth in this Ordinance to each elector of the munici- <br />pality whose name appears upon the registration books for the last
