RESOLUTION NO. 87-62 <br />INTRODUCED BY: Mayor Carmen & Council as a Whole <br />A RESOLUTION AUTHORIZING THE MAYOR AND PRESIDENT <br />OF COUNCIL TO EXECUTE A CONTRACT WITH BURGESS & <br />NIPLE, LIMITED, TO PREPARE A STORM DRAINAGE STUDY <br />FOR PIAYFIELD VILLAGE IN AN AMOUNT NOT TO EXCEED <br />TWENTY NINE THOUSAND DOLLARS ($29,000.00) AND <br />DECLARING AN EMERGENCY. <br />BE IT RESOLVED BY THE COUNCIL OF MAYFIELD V ILLAGE, OHIO, THAT: <br />Section 1. The Mayor and President of Council are hereby <br />authorized and directed to execute a contract with Burgess & Niple, <br />Limited, to prepare a storm drainage study for Mayfield Village in an <br />amount not to exceed Twenty Nine Thousand Dollars (529,000.00) <br />provided that such contract, including the contract price, is <br />consistent with the proposal from Burgess & Niple, Limited, dated <br />April 29, 1987, a copy of which is attached hereto, marked Exhibit "A" <br />and incorporated herein as if fully rewritten. <br />Section 2. That the Council finds and determines that all <br />formal actions of this Council relating to the adoption of this <br />Resolution have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in <br />compliance with all statutory requirements including the requirements <br />of Section 121.22 of the Ohio Revised Code. <br />Section 3. This Resolution is hereby declared to be an <br />emergency measure necessary for the immediate preservation of the <br />health, safety and welfare of the residents of Mayfield Village for <br />the reason that the contract authorized herein is necessary to <br />commence a program to improve storm drainage throughout the municipal- <br />ity. It shall therefore take effect immediately upon passage by the <br />affirmative vote of not less than four (4) members elected to Council <br />and approval by the Mayor or otherwise at the earliest time allowed by <br />law. /~ /~ <br />to Basile, Council President <br />First Reading: Ju1~20, 1487 <br />Second Reading: Suspended <br />Third Reading <br />PASSED: July <br />APPROV ED. ~' <br />Fred N.
