SECTION VIII - SERVICES TO BE FURNISHED BY THE OWNER A. It is understood that: 1. All available information, including previous engineering or architectural reports; existing, proposed, or pending subdivision of land; elements of planning reports, such as population studies, land use studies, and zoning regulations; topographic maps; aerial photographs; tax maps; soils information; grade profiles of existing state, county and local roads; sizes of existing facilities; and financing data shall be turned over to the E/A insofar as they are available or may be secured by the Owner's officials. The Owner will provide all legal services, land title research, land surveying, and other services as indicated to assure title as required for all property, land and water rights, easements and rights-of-way, and assume responsibility for clearance of such titles. The Owner will provide subsurface borings or underground investigations as required for the proposed improvements. The Owner will -pay fees charged by governmental regulatory agencies as part of their approval of detailed construction plans and specifications. The cost of furnishing the services as indicated under 1 through 4 immediately above shall be borne by the Owner as a cost separate and apart from the fees paid to the E/A under the terms of this contract, except as may be otherwise noted. SECTION IX - PAYMENT FOR PROFESSIONAL SERVICES A. The Owner agrees to pay the E/A as compensation for professional services rendered as follows: 1. Payment for services to be rendered under SECTION II shall be made to the E/A on an hourly basis plus reimbursable expenses. A maximum fee for such services shall not exceed $29,000.00 unless additional authorization is received from the Owner. Additional meetings after presentation of the report will be attended on an hourly basis. 2. Payment for services to be rendered under SECTION III shall be made to the E/A on an hourly basis plus reimbursable expenses. A maximum fee for such services will be established at the time of authorization. Payment for services to be rendered under SECTION IV shall be made to the E/A on an hourly basis plus reimbursable expenses. A maximum fee for such services will be established at the time of authorization.
