RESOLUTION NO. 87- 65 <br />INTRODUCED BY: Mayor Carmen & Council as a Whole <br />A RESOLUTION GRANTING A SPECIAL USE PERMIT TO ALAN <br />AND WANDA HEJCL TO USE CERTAIN PREMISES WITHIN THE <br />MUNICIPALITY FOR A FLORIST SHOP, ESTABLISHING <br />RESTRICTIONS ON SAID USE AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, the Hi-Bank Florist Shop has existed as a valid <br />non-conforming use at 673 SOM Center Road in Mayfield Village as a <br />business located on property zoned for single-family residential use; <br />and <br />WHEREAS, the municipality recently authorized the relocation <br />of a single family residential structure onto the same parcel on which <br />the Hi-Bank Florist Shop is located; and <br />WHEREAS, the relocation of the single-family residential <br />structure onto the subject premises has resulted in two (2) zoning <br />uses on one (1) parcel of land; and <br />WHEREAS, the owner of the Hi-Bank Florist Shop is also the <br />owner of a single-family residential structure relocated on the <br />subject property, to wit: Alan and Wanda Hejcl; and <br />WHEREAS, the Mayor and Council of the municipality have <br />i ~ determined that to order the cessation of one of the two (2) zoning <br />'~. uses on the property after first permitting the relocation of the <br />single-family residential structure thereon would create an undue <br />hardship on the aforesaid owners; and <br />WHEREAS, the Mayor and Council have further determined that <br />because of the unique circumstances set forth hereinabove the Hejcls <br />should be allowed to continue to operate the business known as Hi-Bank <br />Florist Shop; and <br />WHEREAS, the Mayor and Council are desirous of regulating <br />the dual use of the property by authorizing its continued existence by <br />the issuance of a Special Use Permit for the operation of the Hi-Bank <br />Florist Shop pursuant to Section 1149.02 of the Codified Ordinances of <br />Mayfield Village, Ohio; and <br />WHEREAS, the Mayor and Council have further determined that <br />the Special Use Permit issued herein for the continued operation of <br />the subject florist shop should be valid only so long as the said <br />business is owned personally and only by Alan Hejcl, Wanda Hejcl, or <br />both of them; now, therefore, <br />BE IT RESOLV ED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. Council finds that the use of the property at <br />673 SOM Center Road within the municipality as the Hi-Bank Florist <br />Shop will substantially serve the public convenience and welfare and <br />will not substantially or permanently injure the appropriate use of <br />
