RESOLUTION N0. 87- 65 <br />Page -2- <br />the neighboring properties, and further that such use will not be <br />injurious, obnoxious or offensive by reason of emission of refuse <br />water, odor, dust, fumes, vibrations, smoke, gas, noise or otherwise <br />and will not be dangerous or harmful to life, health, property or <br />morals and will not cause undue congestion on the public highways. <br />Section 2. Council hereby confirms the permit and approval <br />granted by the Planning and Zoning Commission of Mayfield Village on <br />to Alan and Wanda Hejcl, personally, to operate <br />the Hi-Bank Florist Shop as a Special Use Permit upon the subject <br />premises subject to the conditions hereinafter set forth. <br />Section 3. The Special Use Permit granted herein is <br />subject to the following terms and conditions: <br />(A) The building existing on the premises and used as the <br />Hi-Bank Florist Shop as of the date hereof shall not be <br />enlarged, altered or expanded; <br />(B) The permitee shall not erect any signs on the subject <br />property except those existing as of the date of the adoption <br />hereof; <br />(C) This permit shall not be assigned or transferred <br />under any conditions; <br />(D) This permit may be suspended for any period of time <br />or revoked by the Planning and Zoning Commission upon ten (10) <br />days written notice and hearing for any one or more of the <br />following reasons: <br />(1) Failure to pay any taxes due to Mayfield Village <br />in connection with the business of the permitee. <br />(2) Operation of the business authorized by this permit <br />in a manner determined by the Planning and Zoning Commission <br />to be detrimental to the health, safety, morals or welfare <br />of the residents of Mayfield Village or in such a manner <br />as to constitute a nuisance, or permitting the grounds or <br />buildings to become unsafe or unsightly; <br />(3) Abandonment of the use of the premises as a florist <br />shop for a continuing period of one (1) year or longer. <br />(E) The Special Use Permit granted herein shall remain <br />in effect only so long as the subject business is owned by <br />Alan Hejcl, Wanda Hejcl, or both of them as individuals only <br />and upon the termination of their ownership of the said business <br />this permit shall be automatically null and void and the <br />subject business shall be terminated immediately. <br />
