RESOLUTION N0. 87- 65 Page -2- the neighboring properties, and further that such use will not be injurious, obnoxious or offensive by reason of emission of refuse water, odor, dust, fumes, vibrations, smoke, gas, noise or otherwise and will not be dangerous or harmful to life, health, property or morals and will not cause undue congestion on the public highways. Section 2. Council hereby confirms the permit and approval granted by the Planning and Zoning Commission of Mayfield Village on to Alan and Wanda Hejcl, personally, to operate the Hi-Bank Florist Shop as a Special Use Permit upon the subject premises subject to the conditions hereinafter set forth. Section 3. The Special Use Permit granted herein is subject to the following terms and conditions: (A) The building existing on the premises and used as the Hi-Bank Florist Shop as of the date hereof shall not be enlarged, altered or expanded; (B) The permitee shall not erect any signs on the subject property except those existing as of the date of the adoption hereof; (C) This permit shall not be assigned or transferred under any conditions; (D) This permit may be suspended for any period of time or revoked by the Planning and Zoning Commission upon ten (10) days written notice and hearing for any one or more of the following reasons: (1) Failure to pay any taxes due to Mayfield Village in connection with the business of the permitee. (2) Operation of the business authorized by this permit in a manner determined by the Planning and Zoning Commission to be detrimental to the health, safety, morals or welfare of the residents of Mayfield Village or in such a manner as to constitute a nuisance, or permitting the grounds or buildings to become unsafe or unsightly; (3) Abandonment of the use of the premises as a florist shop for a continuing period of one (1) year or longer. (E) The Special Use Permit granted herein shall remain in effect only so long as the subject business is owned by Alan Hejcl, Wanda Hejcl, or both of them as individuals only and upon the termination of their ownership of the said business this permit shall be automatically null and void and the subject business shall be terminated immediately.
