19 Permits and Fees; Penalty _ 1309.11 <br />(a) The charges for professional services of the Municipal Engineer, Law Director <br />or other professional services shall be at the then current rate paid by the <br />Municipality. <br />(b) In the event that the deposit by an .applicant as required pursuant to this <br />section is insufficient to reimburse the Municipality, then 'the applicant <br />shall be required to deposit additional funds in equal amounts of two hundred <br />fifty dollars ($250.00) as requested by the Building Commissioner. <br />(c) The balance of any deposit remaining after the payment of all charges shall be <br />.refunded to the applicant within sixty days following the completion of the con- <br />struction; the granting or refusal of a special use permit; the approval of the <br />preliminary and final site development plans or the granting or refusal of an <br />application for rezoning. <br />(Ord. 87-32. Passed 1-18-88.) <br />1309.08 LANDSCAPING PLAN REQUIRED. <br />No building permit shall be granted for the construction of an apartment, commercial <br />or industrial development or any other structure or development, other than for single <br />resident buildings, unless there is submitted with the application a landscaping plan <br />prepared by an architect registered under the laws of one of the states of the United States <br />of America, in connection with the proposed construction. The landscaping plans shall <br />be approved by the Planning and Zoning Commission, Council and the Architectural <br />Review Board. (Ord. 73-24. Passed 6-18-73. ) <br />1309.09 EXCAVATION, GRADING, FILLING PERMIT; FEE. <br />The Building Commissioner shall, before issuing any permit for construction involving <br />excavation, grading, filling or hauling of earth to or from the site of the construction, <br />collect from the applicant for such permit, the following amounts,. unless the Commissioner <br />and Municipal Engineer hereinafter designated, agree upon different amounts, in the <br />following cases, which shall go into a General Fund of the Municipality, to be paid to the <br />Municipal Engineer hereinafter designated: <br />(a) Single and two-family residential buildings, thirty-five dollars ($35.00); <br />(b) All other residential buildings, commercial and industrial buildings ten dollars <br />($10.00) per 1,000 square feet of floor space, counting all floors, minimum fee <br />fifty dollars ($50.00); maximum fee three hundred dollars ($300.00). <br />The Commissioner shall also collect from the applicant the sum of five dollars <br />($5.00) to pay for the services rendered by the Municipality, <br />(Ord. 1072. Passed 9-16-68. ) <br />1309.10 MUNICIPAL ENGINEER TO SET AND CHECK PROPERTY GRADES. <br />In each case of new construction, the Building Commissioner shall designate the <br />Municipal Engineer, or any other competent licensed engineer, to establish, set and <br />check the grades for such property, (Ord. 1072. Passed 9-16-68. ) <br />1309.11 PROPERTY GRADESo CRITERIA, APPEAL. <br />In establishment, setting and checking of grades in setback lines, the Municipal <br />Engineer shall consider the natural topography of the property upon which construction <br />is intended, the finished grades of adjoining premises, the location of public utilities in <br />relation to the premises being improved, the contemplated use of the premises being <br />1988 Replacement <br />
