1309.12 BUILDING CODE 20 <br />improved, the contemplated use of the premises and the uses permitted of undeveloped <br />adjoining properties, if any, under applicable zoning regulations. The minimum grade <br />above the street level for single and two-family residential buildings shall be eighteen inches. <br />Any person dissatisfied with the grade finally established or set by the Engineer may, <br />within ten days, file a notice of appeal, in writing, to the Architectural Review Board of <br />the Municipality, which shall consider the criteria required to be observed by the Engineer, <br />as hereinabove set forth, accord a hearing to all interested parties, including land owners, <br />and may affirm or modify the Engineer's determination. The order of the Board may be <br />appealed within ten days to Council, by filing written notice with the Clerk of Council. <br />(Ord. 69-32. Passed 6-16-69.) <br />1309:12 GRADING APPROVAL AND INSPECTION. <br />After the lot and all buildings thereon are surveyed and staked, the owner or builder <br />shall give at least twenty-four hours notice to the Building Commissioner that the grade is <br />ready ~o be set by the Municipal Engineer. After the grade is set and the setbacks approved <br />by the Engineer, and the footer forms are set but not poured, the builder or owner shall <br />again give at least twenty-four hours notice for a final inspection of the grade by the Engineer. <br />The Engineer shall then give the Commissioner a report in writing, and no building permit <br />shall be issued until the provisions of this chapter have been complied with. <br />(Ord. 1072. Passed 9-16-68. ) <br />1309.13 APPLICATION FOR SIDEWALK PERMIT. <br />An application for a permit shall be required for each owner of property who shall <br />construct or replace a sidewalk within the .public right of way. The application shall <br />contain the name and address of the applicant, a' brief description of the work to be done <br />and the approximate date of completion of the work. The application shall be filed with <br />the Building Commissioner. (Ord. 74-29. Passed 5-20-74: ) <br />1309.14 SIDEWALK PERMIT FEE. <br />A base permit fee of ten dollars ($10.00) plus one dollar ($1.00) per 100 square feet <br />shall accompany each application for a permit as provided in Section 1309.13. The fee <br />shall cover the cost of two inspections of the work, the initial inspection to the made after <br />the forms are set and a final inspection to be made upon completion of the work. <br />(Ord. 74-29. Passed 5-20-74.) <br />1309.15 LINE AND .GRADE SETTING FEE . <br />Where it is determined by the Municipal Engineer or by the Building Commissioner <br />that it is necessary to establish line and grade settings, an additional fee shall be paid. <br />The fee shall be determined by the Engineer based on work required by the Engineer at <br />rates then in effect for such work. This fee shall be in addition to the permit fee as <br />provided in Section 1309.14. (Ord. 74-29..
