139.03 ADMINISTRATIVE CODE 36 <br />139.03 AUXILIARY POLICE; CREA'T'ION AND RULES AND REGULATIONS. <br />(a) Approval of Establishment. .Council hereby approves the establishment of an <br />Auxiliary Police Unit within the Police Department, to work in times of war and other <br />emergency and to train and prepare for such occasions, as part of the civil defense <br />program of the Village, and to exercise all of the powers conferred by Ohio R.C. 737.161, <br />all under the direction of the Chief of Police under the control of the Mayor. <br />(b) Approval of Constitution, B -Laws and Rules and Regulations The Constitution, <br />By-Laws and Rules and Regulations governing the Auxiliary Police of Mayfield Village, <br />dated January, 1976, and filed with Council, are hereby approved and made a part hereof <br />insofar as not inconsistent with law. (Ord. 76-8. Passed 3-15-76. ) <br />EDITOR'S NOTE: Council amendments to the Constitution, By-Laws and <br />Rules and Regulations referred to herein are as follows: <br />Ordinance Passed <br />78-55 ~ 11-11-78 <br />139.04 DISPOSITION OF PROPERTY HELD BY POLICE DEPARTMENT. <br />(a) Personal property which has been lost, abandoned, stolen or lawfully seized <br />or forfeited, and which is in the custody of the Police Department, shall be~safely kept <br />pending the time it is no longer needed as evidence, and disposed of pursuant to this <br />section. <br />(b) The Department shall make a reasonable effort to locate the persons entitled to <br />possession of property in its custody, and to notify them when and where it may be claimed. <br />In the absence of evidence identifying persons entitled to custody, it is sufficient notice <br />to advertise in a newspaper of general circulation in the County for two consecutive weeks, <br />such advertisement to briefly describe the nature of the property in custody and .inviting <br />persons to view and establish their right to possession of such property. <br />(c) A person loses any right he may have to possession of property: <br />(1) Which was the subject, or was used in a conspiracy or attempt to commit, <br />or the commission of, an offense other than a traffic offense, and such <br />person is a conspirator, accomplice or offender with respect to the offense; or <br />(2) When, in light of the nature of the property or the circumstances of such <br />person, it is unlawful for him to acquire or possess it. <br />(d) Unclaimed, forfeited and seized property in the custody of the Department shall <br />be disposed of by the Chief of Police, with the approval of the Mayor, as follows: <br />(1) Drugs shall be destroyed or placed in c ustody of the Secretary of the Treasury <br />of the United mates for disposal or use for.. medical or scientific purposes <br />under applicable Federal law. <br />1988 Replacement <br />
