36A Police Department 139.04 <br />(2) Firearms and dangerous ordnance suitable for police work may be retained <br />by the Department for that purpose or given to another law enforcement agency <br />for that purpose. Firearms and dangerous ordnances may also be sold to <br />licensed firearms dealers as a credit against the purchase of firearms, <br />dangerous ordnances or ammunition for use in the Department. All other <br />firearms and dangerous ordnances not retained or otherwise disposed of as <br />specified in this subsection shall be destroyed. <br />(3) Obscene materials shall be destroyed. <br />(4) Other unclaimed or forfeited property may be sold at public auction or otherwise <br />disposed of as the Chief of Police, with the approval of the Mayor, considers <br />proper in the circumstances. <br />(e) The proceeds from property disposed of pursuant to this section shall first be lased <br />for the purposes set forth in subsection (d)(2) hereof. After the aforementioned purposes <br />have first been fulfilled, all other proceeds shall be placed in the General Fund. <br />(f) This section does not apply to the collection, storage or disposal of abandoned <br />junk motor vehicles. This section shall not be construed to rescind or restrict the <br />authority of the Department to keep and dispose of lost, abandoned, stolen, seized or <br />forfeited property under any other applicable ordinance or law. <br />(Ord. 84-31.
