FPR 07/15/88 AMENDED <br />ORDINANCE N0. 88-20 <br />INTRODUCED BY: MAYOR CARMEN AND COUNCIL AS A WHOLE. <br />AN ORDINANCE <br />ENACTING CHAPTER 1365 OF THE <br />CODIFIED ORDINANCES OF HAYFIELD VILLAGE, OHIO, <br />PERTAINING TO CERTIFICATES OF INSPECTION OF <br />RESIDENTIAL DWELLINGS FOR PRIVATE SEWAGE SYSTEMS <br />AND DECLARING AN EMERGENCY <br />WHEREAS, the Council finds that the Cuyahoga County Board of Health's <br />Home Sewage Evaluation Program will identify and correct failing septic <br />systems as to improve the environmental quality of our community as well <br />as protecting public health; and <br />WHEREAS, the Home Sewage Evaluation Program will provide the mechanism <br />for updating those septic systems which, through evaluation, are found to be <br />non-functional; and <br />WHEREAS, it is the intention of Council to pass the costs of such <br />Evaluation Program to the seller; now, therefore, <br />BE IT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: <br />SECTION 1. It is hereby enacted that Chapter 1365 of the Codified <br />Ordinances of Mayfield Village, Ohio, shall read as follows: <br />(:AAPTF.R 1365 <br />CERTIFICATE OF INSPECTION <br />Chapter 1365.01: CERTIFICATE OF INSPECTION AT TIME OF SALE. <br />It shall be unlawful for the owner of any residential <br />dwelling structure or unit, within the municipality, to enter <br />into an agreement to sell or otherwise convey a dwelling <br />structure or unit without first obtaining, from the Cuyahoga <br />County Board of Health, a Certificate of Inspection of such of <br />the private sewage system and then presenting a copy of such <br />Certificate of Inspection to the prospective purchaser or <br />grantee. Said owner shall furthermore obtain from the <br />prospective purchaser or grantee a signed acknowledgement <br />of the receipt of a copy of the Certificate of Inspection. <br />Chapter 1365.02: ISSUANCE OR CERTIFICATE OF INSPECTION. <br />A. Application for a Certificate of Inspection as required by <br />this Chapter shall be made upon forms provided by the <br />Building Commissioner from the Cuyahoga County Board of <br />Health. <br />
