FPR 07/15/88 AMENDED ORDINANCE N0. 88-20 INTRODUCED BY: MAYOR CARMEN AND COUNCIL AS A WHOLE. AN ORDINANCE ENACTING CHAPTER 1365 OF THE CODIFIED ORDINANCES OF HAYFIELD VILLAGE, OHIO, PERTAINING TO CERTIFICATES OF INSPECTION OF RESIDENTIAL DWELLINGS FOR PRIVATE SEWAGE SYSTEMS AND DECLARING AN EMERGENCY WHEREAS, the Council finds that the Cuyahoga County Board of Health's Home Sewage Evaluation Program will identify and correct failing septic systems as to improve the environmental quality of our community as well as protecting public health; and WHEREAS, the Home Sewage Evaluation Program will provide the mechanism for updating those septic systems which, through evaluation, are found to be non-functional; and WHEREAS, it is the intention of Council to pass the costs of such Evaluation Program to the seller; now, therefore, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: SECTION 1. It is hereby enacted that Chapter 1365 of the Codified Ordinances of Mayfield Village, Ohio, shall read as follows: (:AAPTF.R 1365 CERTIFICATE OF INSPECTION Chapter 1365.01: CERTIFICATE OF INSPECTION AT TIME OF SALE. It shall be unlawful for the owner of any residential dwelling structure or unit, within the municipality, to enter into an agreement to sell or otherwise convey a dwelling structure or unit without first obtaining, from the Cuyahoga County Board of Health, a Certificate of Inspection of such of the private sewage system and then presenting a copy of such Certificate of Inspection to the prospective purchaser or grantee. Said owner shall furthermore obtain from the prospective purchaser or grantee a signed acknowledgement of the receipt of a copy of the Certificate of Inspection. Chapter 1365.02: ISSUANCE OR CERTIFICATE OF INSPECTION. A. Application for a Certificate of Inspection as required by this Chapter shall be made upon forms provided by the Building Commissioner from the Cuyahoga County Board of Health.
