ORDINANCE N0. 88- 34 <br />INTRODUCED BY: Mayor Carmen and the Entire Council <br />AN ORDINANCE <br />SUBMITTING TO THE ELECTORATE OF HAYFIELD VILLAGE, OHIO, <br />A PROPOSED At~ffi1IDMEN]T TO THE CHARTER OF THE VILLAGE <br />PERMITTING THE VILLAGE COUNCIL TO MEET IN <br />PRIVATE EXECUTIVE SESSION, PROVIDING <br />FOR ALL NECESSARY PROCEDURES IN CONNECTION HERE{~IITH <br />AND DECLARING AN EMERGENCY <br />WHEREAS, the existing Charter under Article X permits Council, by vote <br />of at least two-thirds (2/3rds) of its members, to propose any amendment to <br />the Charter for submission for approval of a majority of the electors voting <br />thereon; and <br />WHEREAS, the recent ruling of the Ohio Supreme Court has eliminated the <br />possibility of the Council to meet in executive session for the purpose of <br />discussing personnel matters, matters of pending or imminent litigation and <br />the buying or selling of real estate, and without such ability to talk in <br />private, the Village and its taxpayers will be put at a disadvantage in all <br />negotiations, legal matters and personnel matters, where privacy will be <br />necessary for the development of strategy therein; and <br />WHEREAS, the next general election is to be held on Tuesday, November 8, <br />1988, and any such issue must, therefore, be submitted to the Cuyahoga County <br />Board of Elections at least sixty (60) days prior thereto, on September 9, <br />1988. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, <br />THAT: <br />SECTION 1. Pursuant to Article X of the Charter of Mayfield Village, <br />Ohio, the Village Council proposes the following amendment to the Charter of <br />the Village, said proposed amendment to be submitted to the electorate of the <br />municipality at their regularly scheduled General Election to be held on the <br />eight (8th) day of November, 1988. The proposed amendment shall be designated <br />by a ballot question number and shall be further designated by an individually <br />lettered subheading. The proposed amendment and respective ballot question <br />shall be as follows: <br />A. Shall Article III, Section 8, Part (A) of the Charter of <br />Mayfield Village,_Ohio, be amended by repealing, substi- <br />tuting and replacing the existing last sentence of Article <br />III, Section 8, Part (A) so that it reads as follows: <br />
