M.V. ORDINANCE N0. 89-3 Page -2- SECTION 2. The Clerk of Council is hereby authorized and directed to certify a copy of this Ordinance to the Cuyahoga County Board of Elections for approval or rejection by the electorate of Mayfield Village, Ohio, at the Primary Election to be held on May 2, 1989, pursuant to Article III, Section 7, of the Charter of Mayfield Village, Ohio, and directs the Clerk of Council to take whatever other steps necessary in order to comply with all directives of the said Board of Elections in order to secure placement an the ballot as aforesaid. SECTION 3. The Director of Law is hereby authorized and directed to confer with the Board of Elections of Cuyahoga County, Ohio, and the Secretary of State for the State of Ohio regarding the ballot question and to make any changes necessary to comply with current election law so long as the substance of any issue is not changed. In the event of the necessity of a substantial change of any issue, the Council shall first be consulted. SECTION 4. The Clerk of Council is hereby authorized and directed to either mail a copy of the full text of the proposed Ordinance at least thirty (30) days prior to the date of the election as set forth in t.his Ordinance to each elector of the Municipality whose name appears upon the registration books for the last regular election held in the Municipality or shall cause the full text of the proposed Ordinance to be published once a week for not less than two (2) consecutive weeks in a newspaper of general. circulation in the Municipality with the first publication being at least fifteen (15) days prior to the election. SECTION S. All prior Ordinances inconsistent with this Ordinance, in whole or in part, are repealed to the extent necessary to avoid conflict with this Ordinance. SECTION 6. The Council finds and determines that all farmal actions of this Council relating to the adoption of this Resolution have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code. SECTION 7. This Ordinance is hereby declared to be an emergency measure immediately necessary for the health, safety and welfare of the residents of Mayfield Village, Ohio, for the reason that the proposed Ordinance presented herein must be timely filed with the Board of Elections in accordance with the current Ohio law in order to allow the electorate the opportunity to vote
