06/15/89 <br />i ? <br />i s <br />ORDINANCE N0. 89-21 <br />, <br />INTRODUCED BY: Mayor Carmen and Council as a Whole <br />AN ORDINANCE <br />ENACTING CHAPTER 765, OF THE CODIFIED ORDINANCES <br />OF MAYFIELD VILLAGE, OHIO, ENTITLED "PROPANE TANK SALES," <br />PROHIBITING THE COMMERCIAL STORAGE, SALE AND/OR <br />EXCHANGE OF FILLED PROPANE TANKS WITHIN MAYFIELD VILLAGE, <br />ESTABLISHING PENALTIES THEREFOR, AND <br />DECLARING AND IIMERGENCY <br />WHEREAS, the Fire Chief has pointed out to this Council the dangers <br />inherent in a new commercial marketing concept recently introduced to this <br />area involving the exchange of empty propane gas cylinders for full ones, <br />which dangers include the potential for explosion or fire created when filled <br />cylinders are stored in one place, either as a result of a close proximity to <br />automobile traffic, as a result of expansion of the propane (expansion rate of <br />270:1), or from improper handling; and <br />WHEREAS, other dangers and problems are obvious to this Council, specifi- <br />cally the potential for vandalism, the lack of control by the City relative to <br />overfilling or poor maintenance of the cylinders, and the need to continually <br />monitor the situation, in order to control smoking in the area and to insure <br />? that the store personnel are properly trained to recognize the hazards in- <br />volved; and <br />WHEREAS, recognizing the dangers and problems involved, it is the opinion <br />of this Council that such an enterprise would create too great a risk for the <br />citizens of Mayfield Village, and could not be adequately controlled and ought <br />to be prohibited for the health, safety and welfare of the citizens of <br />Mayfield Village. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />SECTION 1. The existing Part 7, Business Regulations, of our Codified <br />Ordinances of Mayfield Village, Ohio, be and the same is hereby amended by <br />enacting Chapter 765, entitled "Propane Tank Sales," to read as follows: <br />CHAPTER 765 <br />Propane Tank Sales <br />765.01 SALE OR EXCHANGE PROHIBITED. <br />No person, firm or corporation shall engage in or carry on the <br />business of storing, for commercial sale or exchange, filled <br />propane tanks or gas cylinders larger than 16 ounces or to sell or <br />exchange such items within Mayfield Village.
