ORDINANCE N0. 89-21 <br />Page -2- <br />765.02 ENFORCEMENT. <br />It shall be the duty of the Building Inspector with the cooper- <br />ation of the Fire Department, to see the enforcement of the provi- <br />sions of this Ordinance. <br />765.99 PENALTY. <br />Any person or persons, either for themselves or as an officer, <br />agent or employee of any person, firm or corporation, who violates <br />any provisions of this Chapter shall, upon conviction of any <br />subsequent, offense, be guilty of a fourth degree misdemeanor. <br />Each day of storage, or each individual sale or exchange shall <br />constitute a new, separate and individual offense. <br />? --? <br />SECTION 2. The Council finds and determines that all formal actions of <br />this Council relating to the adoption of this Ordinance have been taken at <br />open meetings of this Council; and that deliberations of this Council and of <br />its committees, resulting in such formal action, took place in meetings open <br />to the public, in compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />law. <br />SANTO ASILE, Council President <br />SECTION 3. This Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the health, safety and welfare of the residents of <br />Mayfield Village, Ohio, for the reason that it is necessary to prohibit the <br />storage, sale and/or exchange of filled propane tanks larger than 16 ounces <br />with the Village. It shall, therefore, take effect immediately upon the <br />passage by the affirmative vote of not less than five (5) members elected to <br />Council and approval by the Mayor or otherwise at the earliest time allowed by <br />First Reading: <br />Second Reading: <br />June 19 , 1989 <br />Suspended , 1989 <br />Third Reading: Suspended , 1989 <br />PASSED: June 19 , 989 <br />APPROVED : (?`? ? • <br />FRED N.
