<br />that the Council of Ma lield Village. Ohio, pursuant to Article 111, Section
<br />14, of Ihe Village Charter, has proposed (ive (5) Ordirtances amending or repealing the Plynning
<br />and Zoning Code, atl of which will appear on the ballot at the General Election to be held on
<br />7uesday. November 7. 1989 . The full text of each proposed Ordinance is as follows:
<br />Ordinance No. 89-23
<br />Existing Section 1 7 73.03(a), en(itled "Mbtorist Service District," now consisting af Subsec-
<br />tion ( t)(A) through (1)(C) is hereby arnended by deleting automobile bodies lrom existing $ubsec-
<br />lion 1173.03 (a)(1)(A)(2) and entirely deleting Subsection'1173.03 (a)(1)(A)(4), entitled
<br />"Garages lor storage antl repair of buses," so that the amended Section 1173.03 (a) shall read
<br />as follows: .

<br />A. Automotive (acilities.
<br />1. Service Stations (or the sale of pasoline and oil ;n open areas: lhe sale Of accessories,
<br />the lubrication and peAorming o( minor repairs lo tires, batteries, ignition and Cooling systems
<br />within wholly enclosed buildings.
<br />2. Garages (or the repair of automobile motors within wholly enclosed buildings.
<br />3. Open parking lacilities (or'automobiles, except lhat the parkinp of used cars for sale or

<br />C. Eating places. Serving foad and beverages in wholly enclosed buildings, provided that no

<br />8. Restaurants and assembly rooms in conneclion with motels.

<br />Class U-3AA or Restricted MuNi-Story ApaRment House Oistrict,

<br />Existing Seclion 1181.01 0( the Codified Ordinances of Maylield Yllaqe, Ohio, is hereby
<br />amended to read az tollows:

<br />No buildinp or structure shall be erected to a heipht in excess o( hvo and one-half (2 %) stwies
<br />or in excess of thirty-five (35) (eet, except that in the case o( a church, school a library buadinq,
<br />it shall not be erected to a heipht in ezcess of (our (4) stories or in excess of fifty (50) feet.
<br />Existing Section 1181.02 of the Codified Ordinances o( Mayfield Yllape, Ohio, is hereby
<br />amended to read as follows: '
<br />1181.02 HelQht Exceptlons.
<br />aj The provisions o( Section 1 181.01 shall not apply to restrict the heipht of a church spire,
<br />? belfry, clock tower, chimney Ilue, elevatw bulkhead, air conditioninp unit or other necessary
<br />accessory building equipment normally maintained above the roof line, but such provisions
<br />shall apply to all other structures, inGudinp towers and water tanks. Elevator biilkheads, air
<br />condition units or other necessary buildnp equipment extendinp above the root tine of a buildinp
<br />shall be encbsed with a solid cover desipned to con(ortn !o the architectural style o( the buifdinp
<br />so as to provide an adequate and aesthetic screen.
<br />b) Nothinp in this Zoninq Code shaq prevent the erection above the heipht limit of a parapet
<br />wall o( cornice, solely for ornament end without windows extendinp above such heipht limit,
