<br />1157.05 RESTRICTED MULTI-STORY APARTMENT HOUSE DISTRICT.
<br />(a) Permitted Bulldlnpa end Usee. Except es otherwise spectically provided in this section,
<br />no building or premises in e U-3AA Restricted Multi-story Apartment House District, shall hereafter
<br />be erected, allered,'used, arranged or desipned to be used in whole or in part (or other than
<br />one or'more o( the speci(ied uses, as lollows:
<br />(1) all uses permitted and es reguleted in a Single-Family District,
<br />(2) Multi-story epaRment house accommodations and accessory'lacilities.
<br />(3) Fire stalions and municipal uses.
<br />(b) Accessory Uses. The following accessory uses and buildings are permitted in a U•3AA
<br />Restricted Multi-story Apartment House District:
<br />(1) Within a main building, the-oltice of a surgeon, physician, clergyman, lawyer, architect,
<br />engineer or similar professional person residing in such main building and employing in such
<br />oftice a limited number of nonresident oHice or laboratory assistants provided no sign or other
<br />outward evidence o( the occupation is displayed on the premises.
<br />(2) Parking garages and parking spaces for the occupants of the premises, their guests and
<br />employees.
<br />(3) Any other accessory use customarily incident to a use in a residence district including but
<br />not limited to service and maintenance facilities for buildings, grounds and occupants, their
<br />guests and employees.
<br />(4) Recreational and community facilities (or the benetit of residents.
<br />(5) Adequate storage facilities shall be provided.
<br />(6) Private clubs whose membership is limited to residents of the building and which is operated
<br />lor the benetit o( members only. Nothing shal6prohibit members trom extending guesl privileges
<br />to their relatives and friends.
<br />(c) Requlred Gerage and Parking Space.
<br />(1) Garage parking space to accommodate two motor vehicles lor each apartment of two or
<br />more bedrooms and one space for each of all other apartments. Exterior or garage parking
<br />shall be provided (or guests and employees equal to twenry-(ive percent o1 the required ten-
<br />ant parking. No space in a driveway shatl. be considered a parking space.
<br />(2) All driveways and parking spaces shall be smoothly graded, hard surtaced and adequately
<br />drained.
<br />(3) Adequate facilities for loading or unloading and (or service and maintenance shall be pro-
<br />vided in each main building.
<br />(d) Helght Llm(t. The minimum height of any main building in a Class U-3AA District shall be
<br />120 (eet. There shall be no other height limitation provided lhe building conforms to minimum
<br />yard and land coverage restrictions.
<br />(e) Site Planning Restrictlona. There shall be no less than 150 ieet between all main buildings
<br />constructed in a Class U3AA District. On propeRies divided by municipal boundary Iines the
<br />area of the entire property lying within both municipalities may be used in computing the percen-
<br />tage of coverage.
<br />The property for each Multi-story apartment development within a Class U-3AA District shall
<br />have a minimum area of seven acres. -
<br />(I) Area Requirements
<br />(1) No tower building including garage facilities shall exceed a maximum coverage of twenty-
<br />five percent of the lot area.
<br />(2) Parking space lor each motor vehicle including access and struetural supports shall have
<br />a minimum area of 270 square feet, there being no limitation in the number o( motor vehicles
<br />permitted.
<br />(g) Bullding Plens. Building plans shall be approved by the Planning and Zoning Commission
<br />and Council because of the peculiac nature of the Multi-story Apartment House District, but ap-
<br />proval o( the Archilectural Review Board need not be obtained. Council shall require a perlor-
<br />mance bond,or other security.

<br />Existing Section 1 157.03, entitled: "Occupaney Regulations," now consisting o( Subsection
<br />(b) that permits roomers in a Class U-1 and U-2Use District is hereby amended by deleting
<br />Subsection (b), entitled "Roomers," so that the new Section 1 7 57.03 wilf read as follows:
<br />1157.03 OCCUPANCY REGULATIONS;
<br />(a) FAMILY. In a Class U-1 and U-2 Use District, the de(inition of "lamily," as lound irt Section
<br />1145.01(k) is hereby modified' and amended to read as (ollows;
<br />''Family" means one or more persons, related by blood, marriage or adoption, or nof more than
<br />three persons of the same sex not related by blood, marriage or adop(ion; who live together
<br />in a dwelling unit as a nonprofit housekeeping unit, as distinguished (rom a group occupying
<br />a boarding, lodging or tourist house, sorority or fraternity house, hotel or motel:
<br />(b) NUMBER OF PERSONS WHO MAY OCCUPY A DWELLING UNIT:
<br />No person shall maintain, own or lease a dwelling unit (which is delined as a single dwelling
<br />house or half of a two-family dwel(ing house) unless it contains at least 300 square feea of habitable
<br />Iloor area lor the lirst occupant and at leasU 200 additional square teet of habitable Hooc area
<br />lor every additional occupant lhereoC, buF in no case shall any dwelling unit contain less than
<br />the minimum number of square feet of habitable area required by any ordinanee of the Munieipaliry.
<br />Habitable Iloor area shall be considered to mean the Iloor area in rooms used tor living, sleep-
<br />ing, eating or cooking, and complying with Chapter 1321 0l the Building Code, as amended,
<br />pertaining to height and area, and not counting bathrooms, lavatories, closets or basement rooms.

<br />Existing Section 1 153.02(f), entitled "Class U-6 Uses: (Special Permils)," now consisting
<br />of Subsections (1) through (11) is hereby amended by deleting existing Subsection (8), entitled
<br />"Doctors' and Dentists' ONices," and Subsection (10), entitled "Research Laboratory," so that
<br />the amended Section 1 153.02(() will consist o( numbered Sections (1) through (9) and will read
<br />as iollows: -
<br />(f) Class U-6 Uses: (Speciai Permits)
<br />1. Cemetery.
<br />2. Crematory.
<br />3. Any public utility not included in a Class U• 1, U-2, U-3, Local Business District or U-5 use.
<br />4. Church, private school, Iibrary.
<br />5. Community center building, private club, except a club chiet activity of which is a service
<br />customarily carried on as a business.
<br />6. Public park, public piayground, public recreation building, water tower, reservoir.
<br />7. Motor bus terminal and repair depot for buses.
<br />8. Golf course. 9. Any other use which, in the determination of the Planning and Zoning Commission, is in
<br />keeping with the uses permitted herein as Class U-6 uses and is not injurious, obnoxious or
<br />o((ensive by reason of emission o( refuse water, odor, dust, fumes, vibrations, smoke, gas,
<br />noise or otherwise and is not dangerous to life, health, property or morals and will not cause
<br />undue congestion on the public highway.
