*M.V. ORDINANCE N0. 89-49 <br />Page -4- <br />(b) Exemptions. <br />(1) Farms. The developer or the owner of land or his agent <br />developing or using land for the growing of crops, flowers, fruit or <br />nursery stock for sale, in the natural soil unenclosed by any <br />structure other than a fence, shall be exempt from the provisions of <br />this chapter. Such exemption shall be limited to the area of land, <br />designated by the owner and approved by the Planning Commission, <br />which is to be used to grow such crops, flowers, fruit or nursery <br />stock. The area used for the homesite, barns, shed or accessory <br />building shall be subject to Section 1127.01(a) and (b). <br />(2) Governmental agenc_y recreation areas. Governmental agencies, <br />in the development of land areas to be used for recreational purpos- <br />es, shall be exempt from the provisions of Section 1127.01(b). <br />(c) Phasing Developments. Any developer or owner of real property in <br />the Village, or the agent of either, having a tract of land consist- <br />ing in area of five acres or more, may with approval of the Planning <br />Commission, develop his real property in phases, provided that such <br />developer, owner or agent complies with the provisions and condi- <br />tions of this chapter as they apply to the area of this property to <br />be developed in the phase approved for development by the Planning <br />Commission. <br />1127.03 MASTER STORM DRAINAGE PLAN. <br />(a) The Master Storm Drainage Plan, prepared <br />Niple, Consulting Engineers, and dated _ <br />hereby adopted. <br />by Burgess and <br />is <br />(b) After the effective date of this Chapter, all storm water <br />drainage systems to be constructed, serving the area of real proper- <br />ty to be developed within the Village, shall discharge into streams, <br />ditches or retardation basins established for such area on the <br />Master Storm Drainage Plan. <br />(c) (1) Land areas designated on the Master Storm Drainage <br />Plan, as areas "To Be Acquired" are hereby deemed to be <br />necessary for public use to effectuate the purpose of the Plan. <br />(2) After the effective date of this Chapter the Service <br />Director/Building Inspector shall not issue a building permit <br />for the improvement of any land area, within any of the areas
