- M.V. ORDINANCE N0. 89-49 <br />Page -5- <br />designated on the Master Storm Drainage Plan, as <br />areas "To be Acquired," for a period of 120 days <br />after an application is filed for such permit. The <br />Service Director/Building Inspector shall forthwith <br />notify the Mayor, Council and the Director of Law, in <br />writing, of the filing of such application. <br />(3) The Mayor and the Director of Law shall thereafter <br />take immediate action to acquire the designated land <br />area by deed, dedication, purchase or through an <br />appropriation action filed for such purpose. <br />(4) In the event that Council, upon the recommendation of <br />the Village Engineer, deems it appropriate to abandon <br />the land area or to use other areas not previously <br />designated on the Master Storm Drainage Plan, <br />Council shall request, by Resolution, that no action <br />against the applicant be taken to acquire such land <br />area designated and shall direct the Service Direc- <br />tor/Building Inspector to issue the building permit. <br />Council shall thereafter amend the Master Storm <br />Drainage Plan. <br />1127.04 INTERPRETATION; CONFLICTS. <br />The provisions of this chapter are intended to supplement those Ordinanc- <br />es pertaining to the same subject matter also adopted by Council, except when <br />there is an express conflict with the previous Ordinances adopted by Council, <br />in which case the provisions of this chapter shall control. <br />1127.99 PENALTY. <br />Whoever violates or fails to comply with any of the provisions of this <br />chapter shall be guilty of a misdemeanor of the fourth degree and shall be <br />fined not more than two hundred fifty dollars ($250.00) or imprisoned not more <br />than thirty days (30), or both. A separate offense shall be deemed committed <br />each day during or on which a violation or noncompliance occurs or continues. <br />SECTION 2. The Council finds and determines that all formal actions of <br />this Council relating to the adoption of this Ordinance have been taken at <br />open meetings of this Council; and that deliberations of this Council and of <br />its committees, resulting in such formal action, took place in meetings open <br />to the public, in compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code.
