/ <br />ORDINANCE NO. 78-62 <br />INTRODUCED IIY: Robert J. Grogan <br />AN ORDINANCE APPROVING AND ACCPPTING AN EASEMENT <br />P'ROM ROBERT C. AND M. C. BURCH EOR THE CONSTRUCTION, <br />RECONSTRUCTION, MAINTENANCE, OPERATION AND I2EPAIR <br />OF A STORM SBWPR r:ND APPURTENANCES ON CERTAIN PF2EMISES. <br />WHEREAS, the Council of the Villaga of Mayfield by Ordinance <br />No. 657 approved an easement from Elaren, Inc, for the construction, <br />reconstruction, maintenance, operation and repair of a storm sewer <br />and appurtenances on certain premises; and <br />WHEI2EAS, flooding has frequently occurred causing great <br />damage to the property covered by said easement; and <br />WIiERE11S, the Village Engineer has recommended that the <br />construction of a storm sewer on the premises hereinafter described <br />is the best way to prevent further flooding and damage to the • <br />property covered by said Ordinance No. 657; now, therefore, <br />BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF MAYFIELD, OHIO, THAT: <br />Section 1. Council hereby approves and accepts an easement <br />from Robert C. and M.C. Burch, residing at 488 Oakton Circle, <br />Mayfield Village, Ohio for the construction, reconstruction, mainten- <br />ance, operation and repair of a storm sewer on the following described <br />premises: <br />Situated in the Village of Mayfield, County of Cuyahoga <br />and State of Ohio and further being a part of Sublot No. 40 in <br />the Robert Neroni Subdivision No. 1 as recorded in Volume 198, Page <br />63 and 64 of Cuyahoga County Records; <br />Beginning at the southwesterly corner oP said Sublot 40, <br />thence North 36020'48" East, 205.38 feet to the right-of-way line <br />of Oakton Circle (65' radius); <br />Thence along a curve deflecting to the left with a radius <br />of 65.00 feet, an arc length of 20.33 feet and a chord length of <br />20.25 feet which bears South 62036100" East to a point; <br />Thence South 36020'48" West, 194.24 feet to a point; <br />Tlience North 89011' 46" i4est, 24.58 feet to the place of <br />beginning, coiitaining 0.0915 acres of land, be the same, more or less. <br />Said premises are also known as part of Cuyahoga County <br />Auditors Permanent Parcel No. 831-17-29.
