IN THE CITY OF MAYFIELD HEIGHTS <br />ORDINANCE N0. 1978-41 <br />INTRODUCED BY: mayor Ross DeJohn <br />AN ORDINANCE <br />AUTHORIZING THE MAYOR TO ENTER INTO AGREEMENT WITH <br />THE VILLAGE OF rAyEIEI,D <br />FOR THE INTERCHANGE OF POLICE PROTECTION SERVICES, <br />WHEREAS, the mutual interchange of Police Protection Services <br />with the villa9e of Mavfield is beneficial to the City <br />of Mayfield Heights and necessary to protect the safety of the inhabi- <br />tants of the City of Mayfield Heights, <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City of <br />Mayfield Heights, State of Ohio: <br />Section t: That the Mayor be and is hereby authorized and <br />directed to enter into an agreement with the v;iiagP nf Mayf;piri <br />for the services of the police department and the interchange of the <br />services of the police department o?; the parties, thereto, said agree- <br />ment to read in substance as followsa <br />A G R E E M E N T <br />This Agreement, entered into this 11th day of December <br />1978 , by and between the City of Mayfield Heights and the VillaQe <br />of Mavfield , political subdivisions of the State <br />of Ohio: <br />W I T N E S S E T H: <br />WHEREAS, the respective political subdivisions hereinabove- <br />named own and operate certain police equipment and have duly appointed <br />or employed departmant personnel, which in emergencies are available <br />to render additional police protection s.;rvices to each other; and <br />WHEREAS, it is desirable that each of the respective parties <br />hereto have such additional poiice arotection which may be afforded <br />by the equipment, apparatus and personnel of the other party; and <br />WHEREAS, by ordinance duly passed by the Council of the <br />Villa4e of Mavfield on the 19th dey of February, <br />1979 , and by ordinance duly passed by the Council of the City <br />of Mayfield Heights, Ohio, on the llth day of December <br />1978 , the parties hereto were authorized to enter into an agree- <br />ment for the mutual interchange of police protection services; <br />NOW, THEREFORE, it is mutually agreed by and between the partie5 <br />hereto as follows: <br />(1) That each party hereto will assist the other party, who <br />is primarily responsible for rendering police protection services <br />within its boundaries, upon being requested so to do by the Chief of <br />the police department of the political subdivision requesting such <br />assistance or by the person next in charge thereof, by the use of its <br />police department equipment, apparatus and personnel and will render <br />the same services to the political subdivision calling for such assis- <br />tance as is rendered in the performance of said services within its own <br />political subdivision. Provided, however, that at no time will the <br />party upon which said request is madQ be required to respond with <br />equipment or personnel which is necessary to maintain adequate protec- <br />• tion within its own boundaries. <br />(2) That the equipment, apparatus and personnel, responding to <br />said request for additional police protection services, sha11 at all <br />times be under the supervis:on, order and direction of the persons in
