IN THE CITY OF MAYFIELD HEIGHTS ORDINANCE N0. 1978-41 INTRODUCED BY: mayor Ross DeJohn AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO AGREEMENT WITH THE VILLAGE OF rAyEIEI,D FOR THE INTERCHANGE OF POLICE PROTECTION SERVICES, WHEREAS, the mutual interchange of Police Protection Services with the villa9e of Mavfield is beneficial to the City of Mayfield Heights and necessary to protect the safety of the inhabi- tants of the City of Mayfield Heights, NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Mayfield Heights, State of Ohio: Section t: That the Mayor be and is hereby authorized and directed to enter into an agreement with the v;iiagP nf Mayf;piri for the services of the police department and the interchange of the services of the police department o?; the parties, thereto, said agree- ment to read in substance as followsa A G R E E M E N T This Agreement, entered into this 11th day of December 1978 , by and between the City of Mayfield Heights and the VillaQe of Mavfield , political subdivisions of the State of Ohio: W I T N E S S E T H: WHEREAS, the respective political subdivisions hereinabove- named own and operate certain police equipment and have duly appointed or employed departmant personnel, which in emergencies are available to render additional police protection s.;rvices to each other; and WHEREAS, it is desirable that each of the respective parties hereto have such additional poiice arotection which may be afforded by the equipment, apparatus and personnel of the other party; and WHEREAS, by ordinance duly passed by the Council of the Villa4e of Mavfield on the 19th dey of February, 1979 , and by ordinance duly passed by the Council of the City of Mayfield Heights, Ohio, on the llth day of December 1978 , the parties hereto were authorized to enter into an agree- ment for the mutual interchange of police protection services; NOW, THEREFORE, it is mutually agreed by and between the partie5 hereto as follows: (1) That each party hereto will assist the other party, who is primarily responsible for rendering police protection services within its boundaries, upon being requested so to do by the Chief of the police department of the political subdivision requesting such assistance or by the person next in charge thereof, by the use of its police department equipment, apparatus and personnel and will render the same services to the political subdivision calling for such assis- tance as is rendered in the performance of said services within its own political subdivision. Provided, however, that at no time will the party upon which said request is madQ be required to respond with equipment or personnel which is necessary to maintain adequate protec- • tion within its own boundaries. (2) That the equipment, apparatus and personnel, responding to said request for additional police protection services, sha11 at all times be under the supervis:on, order and direction of the persons in
