,. • <br />- . ? <br />-2- Ordinance No. 1978-41 <br />charge of the police department of the subdivision making such call for <br />additional protection services. <br />(3) That Section 701.02 of the Ohio Revised Code, insofar as <br />the same shall be applicable to the operation of the police departments, <br />shall apply to the contracting parties hereto and the police depart- <br />ment members thereof, during the time said members are rendering ser- <br />vices outside their respective political subdivisions. <br />(4) That said police department members shall be entitled to <br />all the rights and benefits of the workers'Compensation Act to the same <br />extent as when performing services within their respective subdivisions <br />and of the police relief and pension fund established by their respec- <br />tive municipalities. <br />(5) That neither of the parties hereto shall be compensated by <br />the payment of any sum or sums for the use of said equipment or for the <br />services required by the members of their respective police departments. <br />(6) That each of the parties hereto shall be responsible for <br />loss or danage to its equipment or apparatus while engaged outside the <br />limits of its territory and within the limits of the subdivision calling <br />for such additional police protection services. <br />(7) That neither of the parties hereto shall be entitled to <br />reimbursement from the other for any pensions paid or for any indemnity <br />award or premium contribution assessed against the employing subdivi- <br />sion for workers' compensation benefits or for injuries to or death of <br />its police department members occurring while engaged in rendering <br />services pursuant to this agreement. <br />(8) That neither of the parties hereto shall be liable for <br />any damages to the other party for failure to answer or neglect in <br />answering any call for additional police protection services or for <br />inadequacy, negligent operation of equipment and apparatus, or for <br />any cause whatsoever growing out of such use of said equipment and <br />apparatus, or lack ofi performance of duties by police department mem- <br />bers. Neither of said parties shall be liable in any manner or event <br />for damages for personal injuries suffered by any member of said police <br />department of the other contracting party hereto. <br />(9) That this agreement shall be for a period of three (3) <br />years on and after Januarv 1, 1979 , provided, however, that <br />either of the parties may terminate this agreement upon thirty (30) <br />days' written notice to the Clerk of Council of the party upon whom <br />said notice is served. <br />Section 2: That it is hereby found and determined that all <br />formal actions of this Council concerning and relating to the passage <br />of this drdinance were adopted in an open meeting of this Council, and <br />that all deliberations of this Council and of any of its committees on <br />or after November 28, 1975, that resulted in such formal action, were <br />in meetings open to the public in compliance with all legal require- <br />ments, including SA-ction 121.22 of the Ohio Revised Code. <br />Section 3: That this ordinance is hereby declared to be an <br />emergency measure necessary for the immediate preservation of the <br />public peace, health and safety. Such necessity exists by reason of <br />the fact that the immediate safety of this municipality requires the <br />aforesaid arrangements for the mutual interchange of police protection <br />• services. Wherefore, this ordinance shall take effect upon its passage <br />and signature by the Mayor.
