<br />continuous or seasonally intermittent. <br />19. Subsoil - That part of the soil below the surface soil <br />or plow layer. <br />20. Surface Soil - The uppermost part (5 to 8 inches) of <br />the soil commonly stirred by tillage implements or its equivalent <br />in uncultivated soils. <br />21. Urban Area - Areas described in the scope of this <br />ordinance (regulation). <br />URBAN SOIL SEDIMENT POLLUTION REGULATIONS: <br />These regulations are intended to protect Ohio's water resources <br />from pollution by soil sediment from accelerated erosion on developing <br />urban areas. <br />General Requirement - No person owning or responsible £or a <br />development area shall cause or allow earth disturbing activities <br />except in compliance with the standards and criteria as set forth <br />below and the applicable item (A or B) below. <br />A. When a proposed development area involves less than <br />five (5) acres, all earth disturbing activities shall be <br />subjected to surveillance and site investigation by the <br />approving agent to determine compliance with the standards and <br />regulations. <br />B. When a proposed development area involves more than <br />£ive (5) acres, the responsible person shall develop and obtain <br />approval of a sediment control plan prior to any earth disturbing <br />activity. Such a plan shall include specific requirements <br />established by the approving agency and be filed with the approving <br />agency. <br />Exception - A statement of policy for sediment control ( a continuing <br />' narrative plan) in conjunction with standard type operations, such <br />as the installation of transmission lines by utility companies or <br />road and highway construction or maintenance and stream channel <br />improvements or maintenance, by public entities or agencies, may be <br />approved by the approving agency in lieu of a specific plan for <br />each development. <br />Al1 plans except those prepared for a public entity or agency, shall <br />be accompanied with a filing fee Fifty Dollars ($50.00) to help defray <br />costs of administration. <br />STANDARDS AND CRITERIA: <br />Meeting the following standards and criteria does not relieve any <br />person from liability for sediment damage'to another person's property. <br />A. To control sediment pollution from sheet and rill erosion, <br />no development area shall have an average annual soil loss leaving <br />-4-
