? <br />RESOLUTION N0. 79-39 <br />BY: Council as a Whole <br />A RESOLUTTON GRANTTNG A SPECIAL U-5 USE PERMIT <br />TO JEANNE NIEYERS TO USE CERTAIN PREMISES FOR <br />AN AUTO BODY REPATR SHOP AND TOWING SERVICE <br />FOR AUTOMOBILES FOR A PERIOD OF THREE (3) YEARS. <br />BE IT RESOLVED BY THE COUNCTL OF MAYFTELD VILLAGE, OHIO, THAT: <br />Section 1. Council finds that the use of the property <br />hereinafter described as an auto body repair shop and towing service <br />for automobiles will substantially serve the public convenience and <br />welfare and will not substantially or permanently injure the appro- <br />priate use of the neighboring property, and further that such use <br />will not be injurious, obnoxious or offensive by reason of emission <br />of re£use water, odors, dust, fumes, vibrations, smoke, gas, noise <br />or otherwise and wi11 not be dangerous or harmful to life, health, <br />property or morals and will not cause undue congestion on the public <br />hiqhways. <br />Section 2. Council hereby confirms the permit and approval <br />granted by the Planning and Zoning Commission of Mayfield Village on <br />June 11, 1979, to Jeanne Meyers to operate an auto body repair shop <br />and towing service for automobiles as a Special U-5 use permit upon <br />the following described premises, suBject to the conditions herein- <br />after set forth: <br />Situated in the Village of Mayfield, County of Cuyahoga, <br />and the State of Oh3o, and known as being a part of Original <br />Mayfield Township Lot No. 45, Tract No. l, and bounded and <br />described as follows: <br />Beginning in the center line of S.O.M. Center Road at the <br />most Southeasterly corner of a parcel of land conveyed to Paul <br />Leo Schulz, January 13, 1933, and recorded in Volume 4285, <br />Page 27, of Cuyahoga County Deed Records. Thence due North <br />along the center line oE S.O.M. Center Road 15 feet.to a point. <br />Thence North 890 33' 22.5" West and parallel to Schulz's <br />southerly line a distance of 348 feet to a stone. Thence due <br />North a distance of 243 feet to an iron pipe stake set in a <br />southerly line of land conveyed to the State of Ohio by a deed <br />recorded in Volume 7863, Page 598, of Cuyahog'a County Deed <br />Records. Thence North 690 33' 22.5" West and along a southerly <br />line of land conveyed to the State of Ohio as aforesaid a <br />distance of 180 feet to an iron pin stake. Thence due South <br />and along an Easterly line of land conveyed to the State of Ohio <br />as aforesaicl a distance of 258 feet to an iron pin stake set <br />in a southeasterly corner of land conveyed to the State of <br />Ohio as aforesaid, said pin being also in the Northerly line <br />of a parcel of land conveyed to the Mayfield Rural School <br />District, October 14, 1924, and recorded in Volume 3317, <br />Page 361, of the Cuyahoga County Deed Records. Thence South <br />890 33' 22.5" East and along the southerly line of land conveyed <br />to Paul Leo Schulz as aforesaid a distance of 528 feet (passing
