RESOLUTION NO. 79-39 <br />Page -2- <br />through an iron pin stake at 498 feet) to the place of <br />beginning and containinq 1,185 acres of land according to the <br />survey of S. 3ohn Sheahan, Registered Surveyor, in May, 1961. <br />This Spec3al Permit is granted subject to the following <br />terms and conditions: <br />1. That the strip of land 15 feet wide and extending West <br />from S.O.M. Center Road between parallel lines a distance of <br />348 feet to the stone, as set forth in the legal description <br />of the property, shall not be considered or included in said <br />Special Use Permit and said strip of land shall continue to <br />remain as a Class U-1 Use District and no parking of any <br />vehicles shall be permitted thereon; <br />2. The building existing on the premises as of the date <br />hereof sha11 not be enlarged, altered or expanded; <br />3, The Permittee shall erect a wooden split two-rail <br />fence from the Eastern property line to the Westerly side of <br />S.O.M. Center Road along both sides of the existing 15-foot <br />driveway and shall not be erected more than one foot from the <br />North or South borders of the existing driveway nor shall said <br />fence contain a gate or any opening that could constitute a <br />gate; <br />4. The Permittee shall extend the existing 8-foot fence <br />on the Southern property line eastward to a point equal to the <br />East property line, said fence to include metal inserts or <br />"slats" designed so as to create a fence opaque in nature; <br />5, The Permittee shall erect an 8-foot chain link fence <br />with metal inserts or "slats" designed so as to create a fence <br />opaque in nature on the East property line from the north end <br />of the existing driveway to the North property line; <br />6. All fences either existing or erected in accordance <br />Aerewith shall be kept and maintained in good condition by the <br />Permittee; <br />7. Any sign intended to be visible from S.O.M. Center Road <br />shall be attached to the fence to be erected along the existing <br />15-foot driveway after the sign has first been submitted to the <br />Archi:tectural Review Board for approval; <br />$. This permit shall not be assiqned or transferred without <br />first obtaining the approval of the Planning and Zoning Commis- <br />sion of Mayfield Village; <br />9. No nuisance shall be maintained or permitted on the <br />premises; <br />10. There shall be no burning of tars or rubbish on the <br />premises; <br />11. No auto wrecks are to be kept more than 90 days on the <br />premises; <br />12. This Permit may be suspended for any period of ti.me or <br />revoked by the Planning and Zoning Commission upon 10-days <br />written notice and hearing for any one or more of the following <br />reasons: <br />(a) Failure to comply with any laws or ordinances <br />applicable to the business and operation of the auto body <br />repair shop or towing service for automobiles;
