?.. <br />ORDTNANCE NO. 79- 45 <br />INTRODUCED BY: Mr. Bennett <br />AN EMERGENCY ORDINANCE REGULATING EMTSSIONS <br />FROM INCINERATORS; PROVIDING PENALTIES FOR <br />ILLEGAL OR IMPROPER EMISSIONS; AUTHORTZTNG <br />COOPERATTON WITH THE OHIO ENVIRONMENTAL <br />PROTECTION AGENCY AND STS ENFORCEMENT AGENCIES. <br />WHEREAS, the Environmental Protection Agency has adopted <br />certain standards with regard to air contaminant sources, including <br />incinerators in apartments and commercial buildings; and <br />WHEREAS, tlie Divisi:on of Air Pollution Control of the <br />Department of Publi:c Health and Welfare of the City of Cleveland is <br />the appointed enforcement agency for the Ohio EPA in Cuyahoga <br />County; and <br />WHEREAS, due to a backlog of enforcement requests in <br />Columbus the City of Cleveland has suggested and requested the <br />adoption of a uniform ordinance with regard to emissions from <br />incinerators in order that more efficient local enforcement measures <br />may be undertaken; now, thereEore, <br />BE IT ORDAINED BY THE COUNC2L OF THE VILLAGE OF b1AYFIELD, OHIO, THAT: <br />Sectson 1. No person shall operate an incinerator for <br />the disposal oE refuse or other wastes by burning or for the pro- <br />cessing of salvagaHle material by burning unless the equipment used <br />for such purpose shall comply, as to specifications and operation <br />with all the provisrons oP this ordinance. <br />Sectson 2. The burnsng capacity of an incinerator shall <br />be manufacturer''s or dessgner's guaranteed maxi.mum rate or such <br />other rate as may be determined by the Building Commissioner or <br />Associate Building Comm3ssioner in accordance with good engineering <br />practices. Tn case of conflict, the determination made by the <br />Building Commissioner or Associate Building Commissioner shall <br />govern. <br />Section 3. For purposes of this ordinance, the total of <br />the capacities of all operable furnaces within one (1) system shall <br />be considered as the incinerator capacity. <br />Section 4, No person shall cause or allow to be emitted <br />into the atmosphere from any incinerator or premises or to pass a <br />convenient measuring point near the stack outlet, particulate <br />matter in the exhaust gases to exceed 0.10 pounds of particulate <br />matter per 100 pounds of combustible refuse (including its ash and <br />water content) charged for incinerators having capacities equal to <br />or greater than lOQ pounds per hour, or 0.20 pounds of particulate <br />matter per 100 pounds of combustible refuse (including its ash and <br />water contentr charged for incinerators having capacities less <br />than 100 pounds per hour.
