The installation or construction of a flue- <br />fed single-flue, single-chamber incinerator is hereafter prohibited, <br />unless such incinerator is equipped with air-cleaning equipment to <br />maintain compliance with the emission limitations otherwise estab- <br />lished in this ordinance. <br />Section 6. Where existing regulations or ordinances of <br />the Village of Mayfield already in effect are more stringent <br />than the requirements of this ordinance, the existing requlations <br />or ordinances shall govern. Otherwise, this ordinance shall take <br />precedence. This ordinance shall not be deemed or construed to <br />repeal any existing regulation regarding to the installation, <br />maintenance or operation of incinerators. <br />Section 7. The Safety Department and the Law Department <br />are authorized to cooperate with the City of Cleveland Division of <br />Air Pollution Control of the Department of Public Health and Wel- <br />fare in the enforcement of this ordinance for so long as the City <br />of Cleveland remains the enforcement agency for the Ohio Environ- <br />mental Protection Agency in Cuyahoga County, Ohio. <br />Section S. Any violation of this ordinance shall be <br />punishable by a fine of not less than One Hundred Dollars ($100.00) <br />nor more than One Thousand Dollars ($1,000.00). Each separate day <br />on which a condition prohibited by this ordinance remains in effect <br />shall constitute a separate violation and may be separately cited <br />and cumulatively fined. <br />Section 9. This is an emergency ordinance immediately <br />necessary for the preservation of the health, welfare and safety <br />of the residents of Mayfield Village, Ohio, for the reason that it <br />offers a method for the control of incinerator emissions which <br />are currently not within the capability of the safety forces of <br />the municipality even though such emissions constitute a hazard <br />to life and health.
