ORDINANCE NO. 79-51 INTRODUCED BY: Mr. Soger AN ORDINANCE GRANTING TO TELERAMA, INC., AN OHIO CORPORATION, A FRANCHISE TO ERECT, MAINTAIN, AND OPERATE IN, UNDER, ABOVE, ALONG, ACROSS AND UPON THE STREETS, LANES, AVENUES, SIDEWALKS, ALLEYS, BRIDGES AND HIGHWAYS AND OTHER PUBLIC PLACES IN THE VILLAGE OF MAYFIELD, OHIO AND SUBSEQUENT ADDITIONS ^1IiERETO, FOR THE PURPOSE OF TRANSMISSTON AND DISTRIBUTION OF TELEVISION SIGNALS TO ENABLE SALE OF TAEIR SERVICES TO THE INHABITANTS OE SAID VILLAGE, FOR A PERIOD OF FIFTEEN (15) YEARS, AND REGULATING THE SAME. BE IT ORDAINED BY THE COUNCIL OF MAYEIELD VILLAGE, OHIO, THAT: Section 1. In consideration of the faithful performance and observance of the conditions and reservations hereinafter specified the nonexclusive right is hereby granted to Telerama, Inc., its successors or assigns (hereinafter referred to as "The Company"), to erect, maintain, operate and utilize television transmission and distribution facilities and additions thereto in, under, above, alonq, across and upon the streets, lanes, avenues, sidewalks, alleys, bridges, and other public places in the Village of Mayfield and subsequent additions thereto, for the purpose of transmission and distribution of audio and visual impulses and television energy in accordance with the laws and regulations of the United States of America, and the State of Ohio, and the ordinances and regulations of the Village of Mayfield, for a period of fifteen (15) years from the effective date of this ordinance. Section 2. Wherever used in this ordinance, the word, "television" shall mean a system £or transmission of audio signals and/or visual images by means of electrical impulses. Section 3. It is contemplated that The Company will make arrangements with the Ohio Bell Telephone Company, The Cleveland Electric Illuminating Company, or any other holder of licenses or franchises from the Village for the purposes of using the towers, poles and attachments thereto of said companies for the attachment of television transmission and distribution facilities, subject to all existing and future ordinances of the Villaqe. Section 4. The Company will not erect a separate system of poles in the Village or any street therein, but may erect poles where shown to be necessary when the location and style of pole have been approved by the Director of Service of the Village. The erection of poles shall be subject to all existing and future ordinances and regulations of the Village applicable thereto and under the super- vision of the Director of Service.
