RESOLUTION NO. 79- 78 Page -3- (a) Failure to comply with any laws or ordinances applicable to the business and operation of the auto body repair shop or towing service for automobiles; (b) Failure to pay any taxes due to Mayfield Village in connection with the business of the Permittee; (c) Operation of the business authorized by this Permit in a manner determined by the Planning and Zoning Commission to be detrimental to the health, safety, morals or welfare of the residents of Mayfield Villaqe or in such a manner as to constitute a nuisance, or permitting the grounds or buildings to become unsafe or unsightly; (d) Abandonment of the use of the premises as an ailto body repairishop or towing service for automobiles for a continuing period of one (1) year or longer. Section 3. The Permittee shall have no more than ninety (90) days to comply with all of the terms and conditions of this Special Use Permit or it shall automatically be revoked. Section 4. The Special Use Permit qranted herein shall be in force and effect for a period of three (3) years following the effective date of this Resolution. Section 5. Ordinance 79-39 is hereby repealed. Section 6. This Resolution is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, health, safety and welfare of the residents of Mayfield Village in that it,.will help insure the nuisance free operation of a commercial enterprise in a residential neighborhood thereby protecting the values of the neighboring property. It shall therefore take effect immediately upon passage by the affirmative vote of not less than five (5) members elected to Council and approval by the Mayor or otherwise at the earliest time allowed by law. .. esi of Council PASSED: Octob r 15, 1979 APPROVED: ? ?r?s4k?
