Ordinance No. 74- 30 <br />Introduced by: Mr. B@nriett <br />AN ORDINANCE PRESCRIBING ELIGIBILITY REQUIREMENTS FOR <br />FEDERAL FLOOD INSURANCE AND PROVIDING FOR THE ADMINIS- <br />TRATION OF CONSTRUCTION WITHIN FLOOD PLAIN AREAS <br />BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF MAYFIELD, CUYAHOGA COUNTY, <br />OHIO, THAT: <br />Section 1. Surisdiction. <br />The provisions contained within this Ordinance shall constitute the minimum <br />standards and requirements applicable to the (1) subdivision of land, and (2) the <br />design, construction and quality of materials of all structures in the Village of <br />Mayfield, which are or will be located in areas identified on the most current FIA <br />Flood Hazard Boundary Map (as modified by Mayfield Village) as being Special Flood <br />Hazard Areas. <br />Section 2. Flood Hazard Boundary Map (As Modified by Mayfield Village). <br />The FIA Flood Hazard Boundary Map showing the extent and boundaries of the <br />identified Special Flood Hazard Areas is published and issued by the Federal Insurance <br />Administration (FIA) of the U. S. Department of Housing and Urban Development. The <br />most current edition of the Flood Hazard Boundary Map (No. H39035486001) and dated <br />November 23, 1973) (as modified by Mayfiekl Village) is made a part of this Ordinance. <br />This map is available during normal working hours at Mayfield Town Hall for public <br />inspection. <br />Section 3. Compliance. <br />It shall be unlawful for any person to construct any structure or subdivide <br />any tract of land in an identified Special Flood Hazard Area, or cause same to be <br />done, contrary to or in violation of any of the provisions of this Ordinance. <br />Section 4. Warning and Disclaimer of Liability. <br />This Ordinance shall not create liability on the part of the Village of <br />Mayfield, or any officer or employee thereof for any flood damages that may result <br />upon compliance with this Ordinance or any administrative decision lawfully made <br />thereunder. <br />Section 5. Severability. <br />If any provision of this Ordinance or the application thereof to any person <br />or circumstance is held invalid, the invalidity does not affect other provisions or <br />applications of the section or related sections which can be given effect without the <br />invalid provision or application, and to this end the provisions are severable.
