? <br />Ordinance No. 74- 33 <br />? Introduced by: Mr. Prager <br />AN ORDINANCE SETTING UP CERTAIN REQUIREMENTS FOR SWIMMING <br />POOLS, PROVIDING REGULATIONS FOR THE USE AND OWNERSHIP <br />OF SUCH APPURTENANGES AND PRESCRIBING PENALTIES FOR <br />VIOLATIONS, REPEALING ORDINANCES NOS. 634 AND 770 AND <br />DECLARING AN EMERGENCY <br />WIIEREAS, the subject matter of this Ordinance is necessary because land <br />owners within the Village of Mayfield are constructing and using bathing pools <br />and plunges; and <br />WHEREAS, many of such pools are intended for the sole use of inembers <br />of the immediate family and non-paying guests; and <br />WHEREAS, in the case of swimming pools having filtering devices of <br />equipment, it is necessary that the approval of the installation and use of the <br />same be given by the office of the Director of Health of the State of Ohio. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF MAYFIELD, <br />CUYAHOGA COUNTY, OHIO, THAT: <br />neSection 1. Definitions. <br />? <br />"Public Swimming Pool" is an artificial body of water, with a controlled <br />water supply, used collectively by numbers of persons for swimming, or recreative <br />bathing, but not including family swimming pools or club swimming pools. <br />"Family Swimming Pool" is an artificial body of water with a controlled <br />water supply over 18 inches in depth or 200 sq. ft. of surface area, and used <br />or intended to be used solely by the owner or lessee thereof, and his family, <br />and by friends invited to use it without payment of any fee. <br />"Club Swimming Pool" is an artificial body of water with a controlled water <br />supply used collectively by numbers of persons for swimming or recreative bathing <br />and where such members of a club or association, or families of club members, <br />or guests of club members, and where the public is otherwise excluded. <br />Section 2. Permits. <br />Before work is coTmenced on the constructioit. of a swimming pool, or on any <br />alteration, addition, remodeling or other improvement thereto, an application for a <br />permit to construct, together with plans and specifications and pertinent explanator} <br />data shall be submitted to the Architectural Review Board for review and approval <br />and no part of the work shall be started until the Review Board has evidenced its <br />approval by suitable endorsement upon such plans and specifications. The Building <br />Inspector shall upon such approval of the Board issue a permit. The base permit <br />? shall be,5'10.00 plus $1.00 per 100 sq. ft. of ground area or fraction thereof <br />occupied by the pool and structures (mini_mum square footage fee of $5.00). Such <br />
