Ordinance No. 75-30 <br />Introduced by: Mr. Prager <br />AN ORDINANCE APPROVING AND ACCEPTING EASEMENTS FROM <br />HARRY J. AND ELEANOR EISENMANN AND JOHN A. AND B. M. <br />DE NICOLA FOR THE CONSTRUCTION, RECONSTRUCTION, MAIN- <br />TENANCE, OPERATION AND REPAIR OF A DRAINAGE SWALE AND <br />APPURTENANCES ON CERTAIN PREMISES, AND DECLARING AN <br />EMERGENCY <br />WHEREAS, Council o£ May£ield Village by Ordinance No. 657 approved an ease- <br />ment from Elaren, Inc. for the construction, reconstruction, maintenance, operation <br />and repair of a storm sewer and appurtenances on certain premises, and <br />WHEREAS, flooding has frequently occurred causing great damage to the <br />property covered by said easement, and <br />WHEREAS, the Village Engineer has recommended that the construction of a <br />drainage swale on the premises hereinafter described is the best way to prevent <br />further flooding and damage to the property covered by said Ordinance No. 657. <br />NOW, THEREEORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, CUYAHOGA <br />COUNTY, OHIO, THAT: <br />Section 1. Council hereby approves and accepts easements from Harry J. and <br />Eleanor Eisenmann and John A. and B. M. DeNicola for the construction, reconstruction, <br />maintenance, operation and repair of a drainage swale on the following described <br />premises: <br />PARf RT. T <br />(John A. and B. M. DeNicola) <br />"Situated in Mayfield Village, Cuyahoga County, Ohio, and being <br />a part of Sublot No. 44 in the Robert Neroni Subdivision No. 1 <br />as recorded in Volume 198, Page 63 and 64 of Cuyahoga County <br />Records, bounded and described as follows: <br />Beginning at the southwesterly corner of said Sublot No. 44; Thence <br />North 6036'38" East along the westerly line of said Sublot No. 44, <br />a distance of 242.35 feet to a point; Thence southeasterly along the <br />southerly right-of-way line of Hickory Hill Drive (60 feet wide), <br />5 feet to a point; Thence South 6°36'38" West, 243.5 feet to a point; <br />Thence North 78°15'S3" West along the southerly line of said Sublot <br />No. 44, a distance of 7.53 feet to the place of beginning, containing <br />1,822 sq.ft. of land, be the same, more or less." <br />Said premises are known as a part of Cuyahoga County Auditor's <br />Permanent Parcel No. 831-17-033
