Ordinance No. 76-15 <br />Introduced by: Mr. Barclay <br />AN ORDINANCE AUTHORIZING MAYFIELD VILLAGE, OHIO TO JOIN <br />WITH OTHER MUNICIPALITIES IN LITIGATION AGAINST THE CITY <br />OF CLEVELAND WITH REGARD TO WATER SERVICE; AUTHORIZING <br />THE SUBURBAN WATER TASK FORCE COMMITTEE OF THE CUYAHOGA <br />COUNTY MAYORS AND CITY MANAGERS ASSOCIATION TO COORDINATE <br />EFFORTS AND RECEIVE AND EXPEND FUNDS THEREFOR; AND <br />DECLARING AN EMERGENCY <br />WHEREAS, water consumers in Mayfield Village receive water service from the <br />City of Cleveland; and <br />WHEREAS, it has been reported thae the operation of the water filtration, puri- <br />fication and distribution system of the City of Cleveland may be unable to cope with <br />the requirements of the users of water in Mayfield Village in the forseeable future, and <br />it has been further reported that the funds raised by the rates charged by the City of <br />Cleveland are being imprudently and unnecessarily applied so that the most pressing <br />problems of repair and expansion are not being solved in this City as well as in other <br />parts of the water system; and <br />WHEREAS, due to its demonstrated inability to properly maintain, operate, repair, <br />improve and expand its water supply and distribution system, the City of Cleveland may <br />be unable to adequately cope with the water demands of the residents and other users of <br />water of Mayfield Village presently or in the forseeable future to the detriment of the <br />public safety, health and welfare; and <br />WHEREAS, Mayfield Village and its residents will be deprived of adequate water <br />service in the future unless immediate and proper action is taken; and <br />WHEREAS, by reason of the foregoing, the regionalization of the Cleveland Water <br />System is vitally necessary in order to provide and maintain adequate and equitable <br />water service in the future; now, therefore: <br />BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. Mayfield Village shall join with all other affected municipalities <br />enacting similar legislation in all proper action, litigation or otherwise, to determine <br />and enforce its rights and the rights of its residents with regard to water service from <br />the City of Cleveland and the adequacy thereof. <br />Section 2. Mayfield Village shall join with all other affected municipalities <br />enacting similar legislation in sponsoring engineering, technical studies and legal <br />services for the regionalization of the Cleveland Water System, <br />Section 3. The Water Task Force of the County Mayors and City Managers Associa- <br />tion is authorized to coordinate such legal action and/or negotiation and to employ such <br />professional assistance, legal, technical or otherwise, as it may deem necessary to <br />carry out the intentions of Sections 1 and 2 of this Ordinance. <br />Section 4.
