-4- <br />2.8 SEVERABILITY <br />If any section, clause, provision or portion of this Ordinance is adjudged <br />unconstitutional or invalid by a court o£ competent jurisdiction, the remainder of this <br />Ordinance shall not be a£fected thereby. <br />SECTION 3.0 ESTABLISHMENT OF REGIONAL FLOOD PLAIN DISTRICT <br />The mapped flood hazard areas within the jurisdiction of this ordinance as the <br />same may be amended £rom time to time by the Federal Insurance Administration are <br />hereby designated as the Regional Flood Plain District. The boundaries of this district <br />shall be shown on the Official Zoning Map. Within this district all uses not allowed <br />as Permitted Uses or permissible as Special Exception Uses shall be prohibited. <br />SECTION 4.0 REGIONAL FLOOD PLAIN DISTRICT <br />4.1 PERMITTED USES <br />The following open space uses shall be permitted within the Regional Flood <br />Plain District to the extent that they are no[ prohibited by any other ordinance and <br />provided they do not require structures, £ill or storage of materials or equipment. <br />In addition, no use shall adversely a£fect the efficiency or unduly restrict the <br />capacity of the channels or floodways of any tributary to the main stream, drainage <br />ditch, or any other drainage £acility or system. <br />4.11 Agricultural uses such as general farming, pasture, grazing, out- <br />door plant nurseries, horticulture, viticulture, truck farming, forestry, <br />sod faxming, and wild crop harvesting. <br />4.12 Industrial-coumercial uses such as loading areas, parking areas, <br />airport landing strips. <br />4.13 Private and public recreational uses such as golf courses, tennis <br />courts, driving ranges, archery,ranges, picnic grounds, boat launching ramps, <br />swimmi.ng areas, parks, wildli£e and nature preserves, game farms, fish <br />hatcheries, shooting preserves, target ranges, trap and skeet ranges, hunting <br />and fishing areas, hiking and horseback riding trails. <br />4.14 Residential uses such as lawns, gardens, parking areas and plan areas. <br />4.2 SPECIAL EXCEP.TION <br />All uses other than those specified in 4.1 are permitted only upon application <br />to the Building Commission and the issuance of a Special Exception by the Board of <br />Appeals, as provided in Section 7.5, Special Exception Uses, of this Ordinance. The <br />Regional Flood Plain District encompasses both floodway and floodway fringe areas. There. <br />fore, the Board, as provided in Section 1.23, shall determine whether the proposed Spec- <br />ial Exception use is located within a floodway or floodway fringe area. If it is <br />determined that the proposed use is located within the floodway, the provisions o£ <br />Section 5.0 of this ordinance shall apply. I£ it is determined=hhat the proposed use <br />is located within the £loodway fringe, the provisions of Section 6.0 0£ this ordinance <br />shall apply. All uses shall be subject to standards contained in this Ordinance, <br />
