-3- <br />Mayfield Village shown on the Official Zoning Map as being located within <br />the boundaries of the Regional Flood Plain District. <br />2.12 The flood protection elevation and necessary floodway areas shall be <br />established by the Board of Adjustment as provided in Section 7.52 of this <br />Ordinance. <br />2.2 ESTABLISHFIENT OF OFFICIAL ZONING MAP <br />The Official Zoning Map, together with all explanatory matter thereon and <br />attached thereto, is hereby adopted by reference and declared to be a part of this <br />Ordinance. The Official Zoning Map will be on file in the office of the Clerk of Council. <br />2.3 RULES FOR INTERPRETATION OF DISTRICT BOULVDARIES <br />The boundaries of the Regional Flood Plain District shall be determined by <br />scaling distances on the Official Zoning Map. Where interpretation is needed as to the <br />exact location of the boundaries of the district as shown on the Of£icial Zoning Map <br />the Board of Appeals shall make the necessary interpretation. The person contesting <br />the location of the district boundary shall be given a reasonable opportunity to <br />present his case to the Board and to submit his own technical evidence if he so desires. <br />2.4 COMPLIANCE <br />No structure or land shall hereafter be used and no structure shall be located, <br />extended, converted or structurally altered without full compliance with the terms of <br />this Ordinance and other applicable regulations. <br />2.5 ABROGATION AND GREATER RESTRICTIONS <br />It is not intended by this Ordinance to repeal, abrogate or impair any existing <br />easements, covenants, or deed restrictions. However, where this ordinance imposes <br />greater restrictions, the provision of this Ordinance shall prevail. Al1 other <br />Ordinances inconsistent with this Ordinance are hereby repealed to the extent of the <br />inconsistency only. <br />2.6 INTERPRETATION <br />In their interpretation and application, the provisions of this Ordinance shall <br />be held to be minimum requirements and shall be liberally construed in favor of the <br />governing body and shall not be deemed a limitation or repeal o£ any other powers granted <br />by State statutes. <br />2.7 WARNING AND DISCLAIMER OF LIABILITY <br />The degree of flood protection requined by this Ordinance is considered <br />reasonable for regulatory purposes and is based on engineering and scientific meehods <br />of study. Larger floods may occur or £lood heights may be increased by man-made or <br />natural causes, such as ice jams and bridge openings restricted by debris. This <br />Ordinance does not imply that areas outside the Regulatory Flood Plain District bound- <br />aries or land uses permitted within such district will be free from flooding damages. <br />This Ordinance shall not create liability on the part of Mayfield Village or any <br />o£ficer or employee thereof Por any flood damages that result from reliance on this <br />Ordinance or any administrative decision lawfully made thereunder.
