SUBDIVISION REGULATION FOR FLOOD HAZARD AREAS <br />SECTION 1.0 STATUTORY AUTHORIZATION, FINDINGS OF FACT AND PURPOSE <br />1.1 STATUTORY AUTHORIZATION <br />The Legislature o£ the State of Ohio has delegated to local governmental units <br />the responsibility to adopt subdivision regulations. Therefore, the Council of <br />Mayfield Village, Ohio ordains as follows: <br />1.2 FINDING OF FACT <br />1.21 Flood Losses Resulting £rom Periodic Inundation - The flood hazard <br />areas of Mayfield Village, Ohio are subject to periodic inundation which <br />results in the loss of life and property, health and safety hazards, dis- <br />ruption of commerce and governmental serviees, extraordinary public <br />expenditures for flood protection and relief, and impairment o£ the tax <br />base all of which adversely affect the public health, safety and general <br />wel£are. <br />1.22 General Causes of These Flood Losses - These flood losses are caused <br />by: (1) The cuinulative effect of obstructions in flood plains causing <br />increases in flood heights and velocities, and (2) the occupancy of flood <br />hazard areas by uses vulnerable to floods, or hazardous to other lands, <br />which are inadequately elevated or otherwise protected from flood damages. <br />1.23 Methods Used to Analyze Flood Hazards - This ordinance is based upon <br />a two-step process for reasonably analyzing the flood hazard af£ecting <br />specific lands. The flood hazard map adopted as part of this Ordinance <br />(Section 2.1) provides the first step by delineating a Regulatory Flood Plain <br />District determined to be subject to £looding, based upon evidence of past <br />flood events. The following information has been used to delineate this <br />district: soil maps, historic flood maps, topographic surveys and such <br />other aids as deemed appropriate for this purpose as the Village Engineer <br />shall determine. When sufficient information becdmes available to designate <br />separate Floodway and Floodway Fringe Districts, this Regulatory Flood Plain <br />District may be separated into the two districts. In areas where this <br />designation has not yet been made the second step involves a determination <br />of the flood hazard at the site of any proposed subdivision (Section 6.12). <br />1.3 STATEMENT OF PURPOSE <br />It is the purpose of this Ordinance to promote the public health, safety and <br />general welfare and to minimize those losses described in Section 1.21 by provisions <br />designed to: <br />1.31 Restrict or prohibit subdivision of lands for uses which aze <br />dangerous to health, safety or property in times of flood or which, <br />with reasonably anticipated improvements, will cause excessive increases <br />in flood heights or velocities.
