-2- <br />1.32 Require that each subdivision lot in an area vulnerable to floods <br />be provided with a safe building site with adequate access and that public <br />facilities which serve such uses be installed with protection against <br />flood damage at the time of initial construction. <br />1.33 Protect individuals Prom buying lands which are unsuited for intended <br />purposes because o£ flood hazard by prohibiting the subdivision o£ unpro- <br />tected flood hazard lands, requiring that £lood hazard areas be delineated <br />on the final plat, and areas not suitable for development be subject to <br />deed restrictions. - <br />SECTION 2.0 GENERAL PROVISIONS <br />2.1 LANDS TO WHICH OFdDINANCE APPLIES <br />This Ordinance shall apply to all lands within the jurisdiction of Mayfield <br />Village, Ohio delineated as flood hazard areas on the Regional Flood Plain District <br />Map. <br />2.2 COMPLIANCE <br />No land shall hereafter be subdivided or used without full compliance with <br />the terms of this ordinance and other applicable regulations including zoning, <br />official maps, health codes, and other regulations which apply to uses within the <br />jurisdiction of this Ordinance. <br />2.3 ABROGATION AND GREATER RESTRICTIONS <br />It is not intended by this ordinance to repeal, abrogate or impair any <br />existing easements, covenants, or deed restrictions. However, where this ordinance <br />imposes greater restrictions, the provision of this ordinance shall prevail. All <br />other ordinances inconsistent with this ordinance are hereby repealed to the incon- <br />sistency only. <br />2.4 INTERPRETATION <br />In their interpretation and application, the provisions of this Ordinance shall <br />be held to be minimum requirements and shall be liberally construed in favor of the <br />governing body and shall not be deemed a limitation or repeal of any other powers <br />granted by State Statutes. <br />2.5 WARNING AND DISCLAIMER OF LIABILITY <br />The degree of flood protection required by this Ordinance is considered <br />reasonable for regulatory purposes and is based on engineering and scientific methods of <br />study. Larger floods may occur on rare occasions or flood heights may be increased <br />by man-made or natural causes, such as ice jams and bridge openings restricted by <br />debris. This ordinance does not imply that areas outside £lood plain areas or land <br />uses permitted within such districts will be free from flood or flood damages. This <br />Ordinance shall not create liability on the part of Mayfield Village or any officer <br />or employee thereof £or any flood damages that result from reliance on this Ordinance <br />or any administrative decision lawfully made thereunder. In no case shall respon- <br />sibility or liability arise from the design or operation of subdivision drainage <br />facilities dedicated to the city if the city has not accepted in writing the dedi- <br />cation and agreed to maintain and operate the facilities. <br />
