-5- <br />4.2 BUILDING SITE IMPROVEMENTS <br />4.21 No subdivision or part thereof shall be approved i£ proposed sub- <br />division development in a floodway will, individually or collectively, <br />significantly increase flood flows, heights, or damages. <br />4.22 No subdivision or part thereo£ shall be approved for floodway or <br />floodway fringe areas which will substantially af£ect the storage capacity <br />of the flood plain. <br />4.23 Building sites, residences, motels, resorts and similar uses for <br />human occupation shall not be permitted in £loodway areas. Sites for these <br />uses may be permitted outside the floodway if the sites are elevated to a <br />height. at least one (1) foot above the elevation of the regional flood or <br />provisions otherwise made for elevating or adapting structures to achieve <br />the same result. Required fill areas must extend fifteen feet beyond the <br />limits of intended structures and, if the subdivision is not to be sewered, <br />must include areas £or waste disposal. <br />4.24 Building si:tes £or structures other than residences outside of flood- <br />way areas shall ordinarily be £illed as provided in 4.23. However, the Board <br />of Appeals may allow subdivisions of areas for commercial and industrial <br />use at a lower elevation if the subdivider agrees to protect the uses <br />through structural flood-proofing as specified (Section 5.4.) <br />4.25 Wlhen the planning agency determines thatonly part of.a proposed plat <br />can be safely developed, it shall limit development to that part and shall <br />require that the method of development is consistent with its determination. <br />4.26 l-]hen the subdivider does not intend to develop the plat himself, and <br />the planning agency determines that limitations are required to insure <br />sa£e development, it may require the subdivider to impose appropriate deed <br />restrictions on the land. Such deed restrictions shall be inserted in every <br />deed and noted on the face of the final recorded plat. <br />4.3 DRAINAGE FACILITIES <br />Storm drainage facilities shall be designed to convey the flow of sur£ace <br />waters without damage to persons or property. The system shall insure drainage <br />at all points along streets, and provide positive drainage away £rom buildings and <br />onsite waste disposal sites. Plans shall be subject to the approval of the Board <br />of Appeals. The agency may require a primarily underground system to accommodate <br />frequent floods and a secondary surface system to accommodate larger, less frequent <br />£loods. Drainage plans shall be consistent'with local and regional drainage plans. <br />The £acilities shall be designed to prevent the discharge o£ excess runoff onto the <br />adjacent properties. <br />4.4 ROADS <br />The finished elevation o£ proposed streets shall be no more than (1) faot <br />below the regional £lood. The Board of Appeals may require, where necessary, profiles <br />and elevations of streets to determine compliance with this requirement. Drainage <br />openings sha11 be sufficient to discharge flood flows without unduly increasing <br />flood heights. <br />
