<br />Ordinance No. 76-31 <br />Introduced by: Council as a1Vhole <br />9N ORDINANCE LEVYING ASSESSMENTS FOR THE IMPROVEMENT <br />OF BEECH HILL ROAD NORTHERLY FROM ITS INTERSECTION <br />WITH SENECA DRIVE A DISTANCE OF APPROXIMATELY 685 FEET <br />BY THE PAVING THEREOF, AND DECLARING AN EMERGENCY <br />WHEREAS, this Council did adopt Resolution No. 936 on the 21st day of <br />June, 1976 declaring therein the necessity of the proposed improvement; and <br />WEEREAS, this Council did on the 13th day of September, 1976 duly adopt <br />Ordinance 1176-22 determining to proceed with said improvement and adopting the <br />estimated assessments as equalized theretofore filed with respect to said <br />improvement; and <br />WHEREAS, this Coimcil did on the 31st day of August, 1976 duly adopt <br />Resolution 11956 determining that said improvement should be made; and <br />WHEREAS, the actual cost of said improvement has now been ascertained <br />and has been placed on file in the office of the Clerk o£ this Council and <br />has been reported to this Coimcil; and <br />WHEREAS, the estimated assessments for said improvements hereto adopted <br />by said Resolution l1936 have been adjusted so that said assessments, as adjusted, <br />are in the same proportion to the estimated assessments as the actual cost of <br />said improvement is to the estimated cost of said improvement; and <br />WHEREAS, said adjusted assessments are now on £ile in the office of the <br />Clerk; now, therefore, <br />BE IT ORDAINED BY THE COUNCIL OF PfAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. The adjusted assessment o£ the cost of the improvement of <br />Beech Hill Road northerly from its intersection with Seneca Drive a distance <br />of approximately 685 feet by the paving thereof in Mayfield Village, Ohio as <br />heretofore reported to this Coiutcil and now on file in the office oP the Clerk, <br />and aggregating in amount of $23,999.57, be and the same hereby is adopted and <br />conformed. <br />Section 2. That there be and hereby are levied and assessed upon the lots <br />and lands boimding and abutting said improvements the several amounts reported <br />in said adjusted assessment as aforesaid, which assessments are in proportion <br />to benefits at the rate o£ $2,157.14 per unit. Said assessments do not exceed any <br />statutory limitation. <br />Section 3. It is hereby determined that the adjusted assessments hereinbefore <br />referred to are in the same proportion to the estimated assessments as the actual <br />cost of said improvement bears to the estimated costs of said improvement upon which <br />such estimated assessments are based. <br /> <br />_I
