<br />(3) Place responsibility for management and <br />maintenance of common property upon the <br />homeowners' association. The Village, at <br />its discretion, may require the applicant to <br />enter into a contract with the Village for <br />maintenance of commonly held properties. <br />(4) Place responsibility for enforcement of the <br />restrictions and covenants on the homeowners' <br />association and also to permit the Village to <br />also enforce the same. <br />(5) Permit each lot to be assessed for its pro- <br />portionate share of maintenance costs for such <br />open space. <br />(d) All open space shall be fully improved by the <br />applicant, as required in the Final Plan, including all <br />utilities, public walkways and streets through or abutting <br />the property. <br />(e) The Village Building Inspector shall be responsible <br />for inspection of the condition and maintenance of all open <br />space commonly owned. In the event that the organization <br />established to own and maintain such property, or any successor <br />organization, shall at any time fail to maintain the same in <br />reasonable order and condition in accordance with the Final <br />Plan, the Village Building Inspector shall serve written <br />notice upon such organization or upon the member residents <br />-38- <br />
