legal provisions to insure continuous <br />maintenance and use of said open space. <br />(b) All areas proposed for dedication to the Village <br />must be acceptable to the Village as to size, shape, location <br />and improvement and shown by the applicant to be of benefit <br />to the general public. Title to all such open space to be <br />dedicated to the Village. shall be conveyed unencumbered <br />within 30 days after each such area is fully improved by the <br />applicant, as required by the Village Planning and Zoning <br />Commission in its approval of the Final Plan. <br />(c) For open space areas proposed for common ownership by <br />the individual owners, all rights of development other than <br />for the use specified in the approved General Plan of Develop- <br />ment shall be conveyed to the Village within 30 days after <br />approval of the Final Development Plan. Legal documents <br />acceptable to Counsel for the Village shall provide i-or the <br />management and maintenance of open space and common facilities. <br />Legal instruments acceptable to counsel for the Village shall <br />provide restrictions and covenants to: <br />(1) Place title to all open space in a form <br />of common ownership by the owners and/or resi- <br />dents of the area, through a duly constituted <br />J ~ and legally responsible homeowners' associa- <br />tion; <br />(2) Appropriately limit the use of all open space; <br />-37- <br />
