LEECH <br />,~ <br />a <br />Q <br />r~. <br />L<i ~ <br />U'J <br />4A <br />Li.! <br />A., <br />~1 <br />AN ORDINANCE TO AMEND ORDINANCE N0. 69-7, ENTITLED <br />"AN ORDINANCE ESTABLISHING REQUIREMENTS FOR GASOLINE <br />SERVICE STATIONS", BY ADDING SECTION 1(a) PERTAINING <br />TO ABANDONED AND INOPERATIVE GASOLINE SERVICE STATIONS <br />Be It Ordained by the Council of the Village of Mayfield, Cuyahoga County, <br />~ Ohio, that: <br />Section 1. Ordinance No, 69-7, entitled "An Ordinance Establishing <br />Requirements for Gasoline Service Stations", is hereby amended by adding Section <br />1(a) which shall read as follows: <br />"Section 1(a). Abandoned and inoperative Qasoline service <br />stations. If any gasoline service station shall become <br />abandoned, such station shall be presumed to be a nuisance <br />affecting or endangering surrounding property values and <br />to be detrimental to the public. health, safety, convenience, <br />comfort, property or general welfare of the community and <br />shall be abated. Abandoned is defined as a failure to <br />operate said service station as a gasoline service station, <br />1) for at least three consecutive months, or 2) for at <br />least three months in any 18-month period. <br />,~~ <br />i <br />~~ <br />~{ <br />Y i <br />L.{.! ' <br />q~ I <br />i <br />W <br />Sdhenever the Building Inspector and Service Director shall <br />find any gasoline service station to be abandoned within <br />the meaning of this section, he shall give notice in the <br />same manner as service of summons in civil cases, or by <br />certified mail addressed to the owner of record of the <br />premises at his last known address or to the address to <br />which tax bills are sent, or by a combination of the fore- <br />going methods, to abate such abandoned condition within <br />60 days after service of said notice, either by 1) placing <br />the station in operation in accordance with the ordinances <br />of the Village of Mayfield, or 2) adapting and using all <br />buildings and land on said premises for another purpose or <br />purposes permitted by the ordinances of the Village of <br />Mayfield, removing the pumps and signs, abandoning under- <br />ground storage tanks in accordance with accepted safe <br />practice as prescribed by the National Fire Protection <br />Association in Appendix C to N.F.P.A. No. 30, under the <br />supervision of the Fire Department of the Village of <br />Mayfield, and filling depressions to the grade level of <br />the lot; provided, however, that if the station is in <br />operation as a gasoline service station at the time the <br />notice is served, and remains in continuous operation <br />for at least three months thereafter, the provisions of <br />this Section shall not apply; and provided, further, that <br />if there should be declared a national emergency which <br />
