.? . <br />i <br />E. <br />-2- <br />WHEREAS, the Council of the City of Mayfield Heights has adopted <br />Ordinance No. 1964 - •,establishing a tap-in fee of Pive Dollars ($5.00) <br />per front foot f or th'e use of said existing water line, to be paid by property <br />owners in Mayfield Village abutting on Ridgebury Boulevard, and upon the <br />payment thereof, providing for the issuance oE a permit to allow. said tap. <br />NOW, THEREFORE, IN CONSIDPRATION OF THE MUTUAL AGP,EEMENTS HEREIN <br />CONTq.INED, to be performed by the parties hereto, it is mutually agreed by <br />and between the City and Village as follows: <br />Sec. 1. Upon the payment of a tap-in fee of Five Dollars ($5.00) <br />per front foot to the City of 14ayfield Heights, property owners in Mayfield <br />Village, abutting on Ridgebury Boulevard may tap into the presently existing <br />Mayfield Heights water line along Ridgebury Boulevard between I.ander Road <br />and Washington Boulevard and between Orchard Heights Drive and the easterly <br />corporatiott line of Mayfield Village. <br />Sec. 2. Such persons who elect to pay such fee sha11 be solely <br />responsible for all costs and expenses incurred in the tap and in the <br />construction of service connections, and shall also save the City of Mayfield <br />Heigh'ts harmless from any and a11 expenses and liabilities whatsoever in <br />connection with said tap. <br />Sec. 3. The tap-in charges shall be payable in full, ip advance, <br />to the Finance Director of the City of Mayfield Heights, who shall, upon <br />payment thereof, issue a'permit'for the service connection. • <br />Sec. 4.
