Sloan <br />AN ORDINANCE AUTHORIZING THE MAYOR AND THE CLIItK TO <br />ENTER.INTO ,AN AGREEMENT WITH THE CITY_OF MAYFISI.D, <br />HEIGHTS FOR THE BSTABLISI3MENT AND PAYMII`1T OF_A TqP-IN <br />F'EE FOR THE USE OF.THE.PRESENTLY EXISTING WATER LINE <br />ALONG RIIJGEBURY BOULEVARD IN THE CITY OF rL4YFIII.D.HEIGHTS <br />@niEREAS, the City of Mayfield Heights presently has a water line along <br />Ridgebury Boulevard, one segment of which is between Zander Road and Washington <br />Boulevard and the other between Orchard Heights Drive and the Easterly Corpor- <br />ation line of riayfield Village, which serves some of the residents of Mayfield <br />Heights; and <br />WNEREAS, some of the residents in the Village of Mayfield are desirous <br />of utilizing the facilities of said water line; and <br />WHEREpS, the Council of the City of Mayfield Heights has approved the <br />establishment of a tap-in fee of $5.00 per front foot for the use of said <br />existing water line, to be paid by property owners in the Village of Mayfield <br />abutting on Ridgebury Boulevard and upon the payment thereof, providing for <br />the issuance of a pexmit to allow said tap-in. <br />NOW THEREFORE BE IT RESOLVfiD BY THE COUNCII. OF THE VII.I.AGE OF DIAYFIEL,D, CUYAHOGA <br />COUNTY, OHIO, THA,Tp <br />Sec. 1. This Council hereby determines it to be necessary and proper to <br />enter ittto an agreement with the City of Mayfield Heights for the establishment <br />and payment of a tap-in fee for the use of the presently existing water line <br />along Ridgebury Boulevard in the City of Cleveland Heights, which agreement <br />is to provide a tap-in fee of $5.00 per front foot, said agreement to be <br />substantially in the form marked Exhibit "A", attached hereto and made a part hereof. <br />Sec. 2. The Mayor and Clerk of the Village of Piayfield are hereby authorized <br />to execute on behalf of said Village an agreement with the City of MayEield Heights <br />in substantially the form set forth in Exhibit "A". <br />Sec, 3. This ordinance is declared to be an emergency measure, necessary <br />for the immediate preservation of the public peace, health, safety and welfare <br />of the Village of Mayfield and its inhabitants, inasmuch as it is necessary to <br />the health of the owners of property abutting said water line that they obtain <br />a supply of water as soon as possible and this ordinance shall take effect and <br />be in force from and after the date of its passage. <br />I Passed this 21st day of September, 1964. <br />? <br />p,ttest: <br />Mayor - President of CouncLl <br />er
