Ordinance No, 857 By Mr. Mason pN ORDINANCE pUTH0RI2ING THE MAYOR AND CLERIC TO IIVTER INTO AN AGREEMINT BETWEEN THE CITY OF MAYFIII.D HEIGHTS AND THE VIL-LAGE OF Ml+XFIELD FOR THE,CONSTRUCTION.OF A WATE[t MAIN .419D THE NECESSARY_APPURTENANCES TNERETO IN,RIDGEBURY BOULEVARD FROM WASHINGDDN BOULEVpRD EASTERLY.TO ORCHARD HEIGHTS DRIVE IN THE CI'fY OF MAYFILT.D HEIGHTS9 AND , DECMING AN EMERGffiVCY. .. . . , WHEREASSthis Council deems it necessary to construct a water main and the necessary appnrtenances in Ridgebury Boulevard from Washington Boulevard Easterly to Orchard Heights Drive itt the City of Mayfield Heightsm Ohio; and WHEREAS, tht Councils of said Municipalities have agreed that it is desirable to construct, maintain and operate said water main by means of a joint agreement eatered i¢to pursuant to the provisiotts of Sections 715.02 attd 727.41 of the Ohio Revised Code. NOW THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF MAYFIELD, CUYAHOGA COUNTY OHIO,- . • - - - . -- - - - - Sec. 1. That this Cou¢cil hereby determinea it to be necessary and proper to enter into an.,Agreement with the City of Mayfield Heights for the construction, maintenance and operation of a water main and appurtenances in Ridgebury Soulevard from Washington Boulevard Easterly to Orchard Heights Drive in the City of Mayfield Heights, which pgreement shall be substantially iu the.fozm marked "Exhibit A", attached hereto and made a part hereof. Sec. 2. That the Mayor and Clerk of the Village of Mayfield shall be and hereby are authorized to execute en behalf of said Village an pgreement with the City of Mayfield Heights in substantially the form set forth in "Exhibit A". Sec. 3. This ordinaace is hereby declared to be an emergency measure* necessary for the immediate preservation of the public peace, health, safety and welfare of the Village of Mayfield and its inhabitantsg and further for reason that the execution of the Agreement hereinabove authorized is necessary in order to accomplish the construction as soon as possible of a water main in Ridgebury Boulevard between the termini set forth above and hereby provide necessary water supply to and thereby eliuninate existing hazards to the health of the inhabitants residing on both sides of said proposed i.mprovement; and tliis ordinance shall take effect and be in force immediately upon its passage.
